Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

as poultry, cows and sheep on a small scale, as in a 4-H project, shall be permitted only on a lot<br />

or tract <strong>of</strong> one acre or more. In the event that the Planning and Zoning Commission receives<br />

written complaint from an adjacent property owner that animals or animal husbandry practices on<br />

a particular lot or tract are causing a public nuisance or preventing an adjacent property owner<br />

from enjoying the use <strong>of</strong> their property, the animal production and husbandry shall be subject to<br />

approval <strong>of</strong> a conditional use permit and the Commission shall schedule a hearing for the<br />

purpose <strong>of</strong> deciding whether such use may continue. The approval <strong>of</strong> a Conditional use permit<br />

for animal production and husbandry in any zone district shall be subject to the following<br />

standards:<br />

a. Sec. 6.10, Conditional uses, and<br />

b. Sec. 5.07, Performance Criteria.<br />

Animal production and husbandry shall not include the commercial feeding <strong>of</strong> <strong>of</strong>fal and garbage<br />

to swine and other animals or any type <strong>of</strong> husbandry specifically prohibited by Ordinance or law.<br />

(5) Home occupation. A home occupation shall be permitted as an accessory use to a<br />

dwelling unit subject to compliance with the following conditions.<br />

a. A home occupation shall be permitted only when it is an accessory use to a<br />

dwelling unit and does not change the essential residential character <strong>of</strong> the use.<br />

b. A home occupation shall not involve any structural alteration in the main building<br />

or any <strong>of</strong> its rooms which changes the residential character.<br />

c. A home occupation shall not involve the installation <strong>of</strong> machinery or additional<br />

equipment other than that customary to normal household operations.<br />

d. Not more than one person other than a member <strong>of</strong> the family <strong>of</strong> the owner or the<br />

user <strong>of</strong> the principal dwelling shall be employed or work in or at such home occupation.<br />

e. A person who engages in a home occupation may have one sign no greater than<br />

two (2) square feet in size on the building in which the home occupation is located.<br />

f. A home occupation shall not operate during the hours other than 8:00 a.m. to 7:00<br />

p.m.<br />

g. A home occupation shall not involve more than four (4) patrons on the premises<br />

at one time.<br />

h. A home occupation shall not generate loud and raucous noise, or utilize<br />

mechanical, electrical or other equipment or items that produce noise, electrical or<br />

magnetic interference, vibration, heat, glare, smoke, dust, odor or other nuisance causing<br />

annoyance outside the residential building or accessory structure by the sense <strong>of</strong> normal<br />
