Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 6.12 Annexations<br />

(a)<br />

Authority<br />

The provisions <strong>of</strong> the <strong>Colorado</strong> Municipal Annexation Act <strong>of</strong> 1965 (“Act”), as the same may<br />

from time to time be amended, shall govern the filing and processing <strong>of</strong> all petitions for<br />

annexation <strong>of</strong> land to the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>. The provisions herein contained are intended to be<br />

complementary and in addition to the Act and not to be construed as altering, modifying,<br />

eliminating or replacing any requirements set forth in that Act, or any requirements set forth in<br />

other sections <strong>of</strong> this <strong>Land</strong> <strong>Use</strong> <strong>Code</strong>.<br />

(b)<br />

Conditions on Annexation; Policies<br />

The <strong>Town</strong> will impose terms and conditions on annexation to protect the public interest and to<br />

that end shall ensure that the following policies are met:<br />

(1) All annexations shall be consistent with the <strong>Norwood</strong> Comprehensive Plan and<br />

the <strong>Norwood</strong> Major Streets and Future <strong>Land</strong> <strong>Use</strong> Plan.<br />

(2) The <strong>Norwood</strong> Major Streets and Future <strong>Land</strong> <strong>Use</strong> plan identifies a Master Plan<br />

Boundary area surrounding the <strong>Town</strong> as an area appropriate for the future residential,<br />

commercial and industrial growth <strong>of</strong> the <strong>Town</strong>. Consent to annexation by petitioning<br />

landowners within the Master Plan Boundary and conformance with the Comprehensive<br />

Plan as amended by the <strong>Norwood</strong> Major Streets and Future <strong>Land</strong> <strong>Use</strong> Plan and the<br />

implementation zoning shall be a condition <strong>of</strong> extension <strong>of</strong> municipal utility service.<br />

(3) There will be no annexations <strong>of</strong> areas outside the boundaries <strong>of</strong> the Master Plan<br />

Boundary indentified by the <strong>Norwood</strong> Major Streets and Future <strong>Land</strong> <strong>Use</strong> Plan, with the<br />

possible exception <strong>of</strong> annexation <strong>of</strong> any acquired open space.<br />

(4) The <strong>Town</strong> is very concerned about long term maintenance costs <strong>of</strong> annexed land.<br />

Petitioners and developers shall identify revenues adequate to pay the long term costs <strong>of</strong><br />

maintenance <strong>of</strong> their development, and the <strong>Town</strong> shall ensure that revenues will be<br />

adequate prior to approval <strong>of</strong> a petition for annexation.<br />

(c)<br />

Pre-submission Conference.<br />

Prior to filing <strong>of</strong> an annexation submission, the prospective petitioner shall meet with the <strong>Town</strong><br />

Planner or his or her designated agent. The purpose <strong>of</strong> the meeting is to allow the petitioner an<br />

opportunity to obtain information regarding the general annexation policies and requirements <strong>of</strong><br />

the <strong>Town</strong>, the relationship <strong>of</strong> the proposed annexation to the comprehensive plan, and to prevent<br />

unnecessary expenditures for preparation <strong>of</strong> annexation submission which may not be consistent<br />

with <strong>Town</strong> Policies and requirements. At such meeting the annexation submission contents,<br />

referral agencies, review procedures, density standards, use and area standards, street<br />

requirements, utility service, long term maintenance costs and the general character <strong>of</strong> the land<br />
