Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
Street: A public way, other than an alley or driveway, which affords the principal means <strong>of</strong> access to<br />
abutting property.<br />
Street, collector: A street which has the primary function <strong>of</strong> carrying through traffic, but which also<br />
provides access to abutting property.<br />
Street, local: A street which has the primary function <strong>of</strong> providing access to abutting property, and<br />
which does not normally carry through traffic.<br />
Street Line: A dividing line between a lot, tract or parcel <strong>of</strong> land and a contiguous street, the<br />
right-<strong>of</strong>-way line or easement line.<br />
Street Width: The dimension <strong>of</strong> the shortest distance between the lines that delineate the right-<strong>of</strong>-way<br />
<strong>of</strong> a street, road or other way.<br />
Street Yard: The area <strong>of</strong> a lot that lies between any street line and the facing wall line or lines <strong>of</strong> the<br />
principal building, extended by imaginary lines from the outer corners <strong>of</strong> the building and parallel to the<br />
street to the property lines. In the case <strong>of</strong> multiple principal buildings located on a building tract,<br />
imaginary lines shall connect the corners <strong>of</strong> facing walls <strong>of</strong> adjacent buildings.<br />
Structural Alterations: Any change in the supporting member <strong>of</strong> a building, such as a bearing wall,<br />
column, beam or girder.<br />
Structure: That which is built or constructed, an edifice or building or any kind or any piece <strong>of</strong> work<br />
artificially built up or composed <strong>of</strong> parts joined together in some definitive manner.<br />
Subdivider: A person, corporation, any other legal entity who causes land to be divided into a<br />
subdivision for him or herself or others or seeks authorization therefor.<br />
Subdivision: The division <strong>of</strong> any parcel <strong>of</strong> land into two or more parcels, separate interests or interests<br />
in common, except when such division: (1) Creates parcels <strong>of</strong> land each 35 or more acres, none <strong>of</strong><br />
which is intended for use by multiple owners; (2) Creates parcels <strong>of</strong> land, such that the land area <strong>of</strong><br />
each parcel, when divided by the number <strong>of</strong> interests therein, results in 35 or more acres per interest; (3)<br />
Is caused by order <strong>of</strong> any court in this state or by operation <strong>of</strong> law;<br />
(4) Is caused by a lien, mortgage, deed <strong>of</strong> trust or any other security instrument;<br />
(5) Is caused by a security or unit <strong>of</strong> interest in any investment trust regulated under the laws <strong>of</strong> this<br />
state, or any other interest in an investment entity; (6) Creates cemetery lots;<br />
(7) Creates an interest or interests in oil, gas, minerals, or water that is now and hereafter severed from<br />
the surface ownership <strong>of</strong> real property; or (8) Is caused by the acquisition <strong>of</strong> an interest in land in the<br />
name <strong>of</strong> a husband and wife or other persons in joint tenancy, or as tenants in common;<br />
unless the Board <strong>of</strong> Trustees finds that steps were taken to establish one <strong>of</strong> the above conditions (1-8)<br />
solely to prevent the division from qualifying for this definition.<br />
Subdivision Improvements Agreement: One or more security arrangement(s) that may be accepted by<br />
