Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
proposal along with an explanation <strong>of</strong> why the amendment should be adopted.<br />
(5) A filing fee shall be submitted to cover the cost <strong>of</strong> review and processing with<br />
every petition in accordance with the fee schedule adopted by resolution <strong>of</strong> the board <strong>of</strong><br />
trustees.<br />
(c) Review by Planning and Zoning Commission. Before taking action on any proposed<br />
amendment, supplement or change, the governing body shall submit the same to the Planning and<br />
Zoning Commission for its recommendation and report.<br />
(1) Public hearing required. The Planning and Zoning Commission shall hold a public<br />
hearing on any application for amendment or change prior to making its recommendation to<br />
the Board <strong>of</strong> Trustees.<br />
(2) Notification requirements for zoning map amendment. When any such amendment<br />
or change relates to a change in the zoning classification <strong>of</strong> property or a change to the<br />
boundary <strong>of</strong> a zoning district, the applicant shall mail the written notice <strong>of</strong> public hearing<br />
before the Planning and Zoning Commission on the proposed amendment or change, after<br />
obtaining a copy <strong>of</strong> the notice from the <strong>Town</strong> Staff, to all owners <strong>of</strong> real property lying<br />
within one hundred feet (100') <strong>of</strong> the property on which the change is requested. The notice<br />
shall be given not less than fifteen (15) days before the date set for hearing by depositing in<br />
the mail such notice properly addressed and postage paid to each such owner as the<br />
ownership appears on the last approved <strong>County</strong> tax roll. Notice shall be mailed to all<br />
owners <strong>of</strong> mineral estates <strong>of</strong> record in the records <strong>of</strong> the <strong>San</strong> <strong>Miguel</strong> county clerk and<br />
recorder. Applicants shall provide pro<strong>of</strong> <strong>of</strong> mailing <strong>of</strong> notice to the <strong>Town</strong> prior to the public<br />
meeting or hearing that is the subject <strong>of</strong> the mailing <strong>of</strong> a notice.<br />
(3) Notification requirements for text amendment. When any such amendment relates<br />
to a change <strong>of</strong> a regulation or to the text <strong>of</strong> this chapter not affecting specific property, the<br />
<strong>Town</strong> Clerk shall cause notice <strong>of</strong> the public hearing <strong>of</strong> the Planning and Zoning<br />
Commission to be given by one publication in a newspaper <strong>of</strong> general circulation in the<br />
<strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> without the necessity <strong>of</strong> notifying property owners by mail. Notice shall<br />
be mailed to all owners <strong>of</strong> mineral estates <strong>of</strong> record in the records <strong>of</strong> the <strong>San</strong> <strong>Miguel</strong><br />
county clerk and recorder. Such notice shall state the time and place <strong>of</strong> such hearing and<br />
the nature <strong>of</strong> the subject to be considered, which time shall not be earlier than fifteen (15)<br />
days from the date <strong>of</strong> publication.<br />
(d) Action by Board <strong>of</strong> Trustees. A public hearing shall be held by the governing body before<br />
adopting any proposed amendment, supplement or change.<br />
(1) The <strong>Town</strong> Clerk shall cause notice <strong>of</strong> the public hearing <strong>of</strong> the Board <strong>of</strong> Trustees to<br />
be given by publication in a newspaper <strong>of</strong> general circulation in the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong><br />
without the necessity <strong>of</strong> notifying property owners by mail. Such notice shall state the time<br />
and place <strong>of</strong> such hearing and the nature <strong>of</strong> the subject to be considered, which time shall<br />
