c. Types of Unfair <strong>Labor</strong> Practices Charged<br />

The most common chaige against employe] s continued to be that<br />

of illegally disci immating against employees because of then union<br />

activities or because of their lack of union membership Employers<br />

were charged with having engaged in such discrimination in 6,240<br />

cases filed during the 1961 fiscal yea' This was 77 percent of the<br />

8,136 cases filed against employe---<br />

The second most common chtirge against employers as refusal to<br />

bargain in good faith with representatives of then employees This<br />

was alleged in 1,676 cases, or 21 percent of the cases filed against<br />

employers<br />

A major charge against unions was illegal restraint or coercion of<br />

employees in the exercise of their rights to engage in union activity oi<br />

to iefraan from it This was alleged in 2,181 cases, or 55 percent of<br />

the 3,939 cases filed against unions<br />

13iscrimmation agaanst employees because of their lack of union<br />

membership was also alleged in 1,958 cases against ittions, or 50 percent<br />

Other major charges against unions alleged secondary boycott<br />

violation in 815 cases, or 21 percent, and refusal to bargain in good<br />

faith in 217 cases, oi 6 percent<br />

d Division of Litigation<br />

The Division of Litigation, which is located in the Washington<br />

Office of the Genei al Counsel, is responsible for the handling of all<br />

court litigation involving the agency—in the Supreme Court, in the<br />

courts of appeals, and in the district courts<br />

During fiscal 1961, the Supreme Court handed down decisions in<br />

10 cases involving <strong>Board</strong> orders Two Boat d ordeis weie enforced<br />

in full, one enfoiced with modification, four were set aside, one lemanded<br />

to the <strong>Board</strong>, and two were remanded to the court of appeals<br />

The courts of appeals reviewed 148 <strong>Board</strong> orders during fiscal 1961<br />

Of these 148 orders, 65 were enforced in full and 35 with modification,<br />

4 were partially enforced and partially remanded to the <strong>Board</strong>, 13<br />

weie remanded to the <strong>Board</strong>, 31 orders were set aside<br />

Petitions for injunction in the district court reached an alltime<br />

high for the fourth consecutive yea' Of the 256 petitions filed<br />

during the year, 255 were filed under the mandatory provision, section<br />

10(1), of the act One petition was filed under the discretional),<br />

provision, section 10(j)<br />

During the year, 71 petitions for injunctions were granted, 13 petitions<br />

were denied, 167 petitions were settled oi placed on the courts'<br />

inactive docket, and 14 petitions were awaiting action at the end of<br />

the fiscal year<br />
