I. Saving and Paying for Higher Education A. Ways to Make Lifetime Gifts to Minors. There are various ways to make lifetime gifts to minors, including gifts to be used to pay for higher education expenses. These include: direct payment of expenses direct gifts Uniform Transfers to Minors Act accounts 2503(c) trusts Crummey trusts for a single beneficiary Crummey trusts for multiple beneficiaries non-Crummey trusts, including Health and Education Exclusion <strong>Trust</strong>s (“HEETs”) Coverdell education savings accounts 529 prepaid tuition programs 529 savings account programs 529 savings accounts with trust wrappers B. Large Estates and Education Funding. Clients with large estates generally seek to move assets out of their estates tax efficiently. Grandparents may be more enthusiastic about making gifts for the benefit of their grandchildren if they believe that they will enable their grandchildren to obtain the best education money can buy. II. <strong>Section</strong> 2503(e) Techniques. Grandparents with large estates should pay their grandchildren’s tuition directly to remove assets from their estates at no transfer tax cost. Tuition payments for grandchildren also benefit children by relieving the children of the responsibility for paying for tuition. Where a beneficent grandparent, aunt or uncle cannot be found, a parent with a large estate should plan to pay tuition directly. Other funding for a beneficiary’s education should be structured taking into account the grandparent’s or parent’s intent to pay tuition directly. Paying $20,000 tuition per year for kindergarten through 12 th grade, and $45,000 per year for five years for an elite private college, would remove almost $500,000 from a grandparent’s estate. Multiply that by several grandchildren, and you have some impressive savings. 2
