LIMITED WAIVER OF
HOMESTEAD EXEMPTION
I, John Doe, am an heir or devisee in the above estate; and
I understand that a primary asset of the estate is the homestead of the decedent at 111
Main Street, Anytown, Minnesota, that has a legal description of Lot 1, Block 2, Green Acres
Subdivision of the City of Anytown, Minnesota.
I further understand that under Minnesota law, the homestead that passes to spouse or
descendants is generally exempt from the payment of most debts and expenses of the decedent in
the administration of the decedent’s estate; and
Mary Doe has been nominated to be the personal representative of the above estate, and
intends to hire Lawrence Lawyer, Attorney at Law, to provide the necessary and required legal
services.
IT IS THEREFORE AGREED:
1. That as an inducement for Lawrence Lawyer to act as the attorney for the personal
representative, I hereby agree to waive my right to exempt the homestead, or the proceeds from
the sale thereof, for the limited purpose of paying for attorney’s fees and any costs of
administering the estate.
2. I have had the opportunity to review this agreement and obtain the advice of
counsel, if desired.
