Federal and Minnesota Individual Tax Update A. Federal Legislative Developments a. Background. The American Taxpayer Relief Act of 2012 (“ATRA”) was enacted January 1, 2013 and signed into law January 2, 2013. i. Congress essentially repealed the expiration provisions under the 2001, 2003 and 2010 tax laws, each of which contained a sunset or expiration provision. b. Tax Rates. The Bush tax regime of 10%, 15%, 25%, 28%, 33%, and 35% tax brackets was made permanent. ATRA added a new 39.6% rate. The IRS recently released the 2013 federal income tax tables, which included inflation adjustments, as follows (www.irs.gov/uac/newsroom/annual-inflation-adjustments-for-2013): i. Individual Filer (Single): $0 to $8,925 = 10% $8,926 to $36,250 = 15% $36,251 to $87,850 = 25% $87,851 to $183,250 = 28% $183,251 to $398,350 = 33% $398,351 to $400,000 = 35% $400,001 and above = 39.6% ii. Married Filing Jointly: $0 to $17,850 = 10% $17,851 to $72,500 = 15% $72,501 to $146,400 = 25% $146,401 to $223,050 = 28% $223,051 to $398,350 = 33% $398,351 to $450,000 = 35% $450,001 and above = 39.6% iii. Married Filing Separate: $0 to $8,925 = 10% $8,926 to $36,250 = 15% $36,251 to $73,200 = 25% $73,201 to $111,525 = 28% $111,526 to $199,175 = 33% $199,176 to $225,000 = 35% $225,001 and above = 39.6% c. Capital Gains. i. Long-term capital gains rate are dependent upon the tax bracket that the taxpayer is in for that particular tax year: Taxpayers in the 15% or lower tax brackets = 0% Taxpayers in the 25% through 35% tax brackets = 15% Taxpayers in the 39.6% tax bracket = 20% ii. Unrecaptured Section 1250 gain and collectibles remain unchanged at 25% and 28%, respectively. d. Qualified Dividends. i. Continue to be taxed at long-term capital gains rates
