INTRODUCTIONGovernment Code Section 14036 requires the <strong>California</strong> Department ofTransportation (the Department) <strong>to</strong> complete a ten-year <strong>State</strong> <strong>Rail</strong> <strong>Plan</strong> with bothpassenger rail and freight rail elements. The law also provides that the <strong>State</strong> <strong>Rail</strong><strong>Plan</strong> be submitted <strong>to</strong> the <strong>California</strong> Transportation Commission by Oc<strong>to</strong>ber ofodd-numbered years for its advice and consent, and <strong>to</strong> the Legislature, Governor,and the Public Utilities Commission by March 1, of the following year.Part I of the <strong>California</strong> <strong>State</strong> <strong>Rail</strong> <strong>Plan</strong> <strong>2007</strong>-<strong>08</strong> <strong>to</strong> <strong>2017</strong>-<strong>18</strong> (<strong>State</strong> <strong>Rail</strong> <strong>Plan</strong>),prepared by the Division of <strong>Rail</strong>, is the Passenger <strong>Rail</strong> Element and examinesintercity and commuter passenger rail services in <strong>California</strong> and reviews theircurrent operations. It also outlines ten-year plans for capital improvements andservice expansions. The Passenger <strong>Rail</strong> Element is covered in Part I, Chapters Ithrough XII.Part II of the <strong>State</strong> <strong>Rail</strong> <strong>Plan</strong>, prepared by the Division of Transportation <strong>Plan</strong>ning,is the Freight <strong>Rail</strong> Element. It provides a description of the freight rail network,issues concerning the freight rail industry, and policy recommendations and goalsfor the maintenance, preservation, improvement, and funding of the system. TheFreight <strong>Rail</strong> element is covered in Part II, Chapters XIII through XIX.1
