Kr. 716/02Serbian Supreme Court in Belgrade, in the Trial Panel comprised of Judges:Aleksandar Ranković as presiding judge, Nikola Milošević, and SonjaManojlović as jurors, Supreme Court counsellor Dragana Jevrić, and thecourt reporter, in the criminal proceedings initiated against defendant SašaCvjetan et al. because of the criminal act pursuant to Article 142 Paragraph1 of the FRY Criminal Code, ruling in the Prokuplje Acting District PublicProsecutor’s request for the transfer of the real jurisdiction, in the sessionon 27 November 2002, brought the followingRULINGIt is determined that the Belgrade District Court should act in the capacityof the court with the real jurisdiction in the criminal proceedings againstdefendants Cvjetan Saša and Demirović Dejan initiated because of the warcrime against civilian population pursuant to Article 142 Paragraph 1 of theFRY Criminal Code.Statement of ReasonsDefendants Cvjetan Saša and Demirović Dejan were charged by the ProkupljeDistrict Public Prosecution’s indictment Cp. number 25/99 filed on 5April 2002 with the commission of the war crime against civilian populationpursuant to Article 142 Para 1 of the FRY Criminal Code and defendantCvjetan Saša was also charged with the aggravated larceny pursuant toArticle 166 Para 1 Item 4 of the Republic of Serbia Criminal Code and thecriminal act pursuant to Article 33 Para 1 of the Law on Weapons and Ammunition.The Prokuplje Acting District Public Prosecutor submitted a proposal to theSupreme Court that the trial of Saša Cvjetan and Demirović Dejan initiatedbecause of the aforementioned acts should be held before the BelgradeDistrict Court with the explanation that the Albanian witnesses proposedin the Public Prosecutor’s indictment could not be held without any incidentsbefore the Prokuplje District Court.99
