Podujevo 1999 – Beyond Reasonable DoubtThe court is telling me that the statement given to the investigative judgein both cases is detailed concerning the distribution of the facilities, the layof the path, the execution of the blonde woman, of ordering the people tostand up along the wall, the issue of orders by precisely determined personsand concerning the shooting itself, relative to the number of rifles, thenumber of people shooting so that something like this could have been describedonly by someone who had really seen all that, who had been onthe spot.And I was asked to say how the inspectors could have known all this if I hadnot given this data to them and had I given them these data.I did not give inspectors this data. I don’t know where the members of theSecretariat of the Interior got it - it was obvious that the data was from thefield. I had received the minutes with these contents, I had signed them,but I was ordered to give such a statement to the investigative judge.I was questioned by the investigative judge, Mijat Bajović, in the districtprison in Priština in the presence of a recording secretary and these two inspectorsof the Secretariat of the Interior who had composed the statementand forced me to sign it.I am emphasising the fact that I didn’t have a defence lawyer, that a lawyerwas not present and that I didn’t even have a lawyer. The investigativejudge practically copied the earlier statement given at the Secretariat ofthe Interior.”Asked whether he had heard the warning issued by the investigative judgethat he had the right to an attorney and whether he had heard that he hadbeen assigned a public defender - lawyer Dragutin Stanković - and the courtwas presenting him with the proof that he had even signed such a statement,the defendant answered: “I insist that the investigative judge has notwarned me of my rights and I would be glad if the lawyer was to come, togetherwith the investigative judge, and all those who were present at thetime of my questioning so that we could look at one another and see whospeaks the truth and whether I did have a defence lawyer.273
