Humanitarian Law Centerprecision concerning the details, as well as at the time of identification, arelogical in view of the age of the plaintiffs, and the fact that these plaintiffshad been in a large group, that they had also been surrounded by a largenumber of uniformed men, so not all of them could perceive the same detailsand described them in the same way, nor give the exact number andappearance of the participants in the event. All this, all these differencesin the details, but agreement concerning the decisive facts speak in favourof these witnesses so the court, after a detailed analysis of their statementshas accepted them fully.On the basis of the statements of plaintiffs Selatin Bogujevci, Safet Bogujevciand Enver Duriqi, it has been determined that the wives and childrenof the Bogujevci brothers, on that day - 28 March 1999 - when they had lefttheir house, had remained in the house together with their mother, auntand her daughter-in-law, and that, in their uncle’s house, there remainedthe parents, wife and children of their friend, Enver Duriqi who had foundshelter there. Enver Duriqi, too, had left the house of the Bogujevci familywhile in the same house his parents, wife and children had remained. Morethan two months after leaving the house, when he heard that Saranda andJehona Bogujevci were in a hospital in Priština, he went to the hospital inPriština with Safet Bogujevci and only then learned that all the members ofhis family were dead.Later on, from the children, Safet and Selatin Bogujevci, he learned thatuniformed persons had taken them out of the house and to the police station,while other uniformed persons had taken his father, Hamdi Duriqi andSeljman Gashi, slapped them, taken them into Drini restaurant and thattwo shots were heard from there. After that, as he was told then, they shotat Shefkate Bogujevci in front of her children, and then shot at other childrenand women. Upon arrival of KFOR, the bodies were exhumed; plaintiffEnver Duriqi attended the exhumation and identified his parents - fatherHamdi and mother Esma, wife Fitneta, daughters Dafina and Mimozaand sons Arb and Arbion. After the arrival of KFOR in Podujevo, plaintiffsEnver Duriqi and Selatin Bogujevci went to the courtyard of Safet Bogujevciand found there 98 cartridge cases which they handed over to the Hagueinvestigators, their children’s shoes, their marbles, and Enver Duriqi foundhis wife’s watch.302
