Humanitarian Law Centerin the manner described in the verdict, he intentionally participated in themurder of 14 persons and wounding of 5 children, whose names are listedin the text of the appealed verdict.This factual background was determined mainly based on the defendantCvjetan Saša’s defence during the first interrogation before the InvestigativeJudge on 24 May 1999 when he admitted the main facts related to thecommission of the crime he is charged with. His admission of guilt is incompliance with the statements given by the eyewitnesses. In the first interrogation,the defendant described in detail the event with injured partyKastrati Rexhep and admitted that he took a pistol from one of the houses;that together with “Gulja”, a young man who was previously searchingthe civilians, and another six or seven persons, shot at a group of civilians.The description of the scene is the same as the one mentioned in KastratiRexhep’s statement, the content of the Investigative Judge’s record fromthe investigation of the scene, and the photo documentation, while thedescription of the event itself is the same as the description given in theinjured parties’ statements and the statement given by witness StoparićGoran.The witnesses-injured parties, juvenile Lirrie, Jahona, Fatos, and SarandaBogujevci, described the main things and the details of the event in almostthe same manner and during the identification process, out of five peoplein the line, they all recognized defendant Cvjetan Saša as one of the peoplein uniform, who were present at the scene. In the first verdict’s Statementof Reasons, the Court presented the detailed content of their statements,evaluated them, evaluated that there was some uncertainty in their statements,and also gave the reasons for accepting such statements, and theSupreme Court is mainly accepting the stance of the first instance Court.Witness Goran Stoparić also testified and by his statement he confirmedthe statements given by the examined children. Among others, witnessGoran Stoparić stated that he saw a group of civilians- women, children,and one man – as they entered the yard escorted by defendant CvjetanSaša; that several other “Scorpions” members were already in this yard;that, after he heard the shooting in the yard, he saw “Scorpions” members,including defendant Cvjetan Saša, coming out of the yard, and they wereall, except for Demirović Dejan, changing the clips of their rifles as they346
