Humanitarian Law CenterThe Supreme Court examined all documents from this case and after it evaluatedthe proposal made, it found that it was founded.In accordance with Article 36 Paragraph 1 of the Criminal Procedure Code,it is possible that another court could be determined as the really authorizedfor the criminal trial if it is obvious that it would be easier for this courtto conduct the procedure or if some other relevant reasons exist.The Supreme Court evaluated that the present course of the criminal proceedingsshows that there are relevant reasons showing that it is necessaryto continue the trial before the Belgrade District Court. Namely, in the furtherprocedure it is necessary to examine a greater number of Albanian witnessesfrom Podujevo and other places in Kosovo and the court is certainthat it would be easier to assure their presence in the main hearing and regulartestimony before the Belgrade District Court.Because of the aforementioned reasons, the Supreme Court found that therequest for the transfer of real jurisdiction based on Article 36 Paragraph 1of the Criminal Procedure Code is founded and it made the decision as presentedin the aforementioned ruling.The Court ReporterDragana JevrićPresiding JudgeAleksandar Ranković100
