Humanitarian Law CenterAs far as I can remember, after the interrogation was conducted and I receivedthe investigation order request, I issued the investigation order anddefendant Cvjetan complained and I forwarded the case to the criminal trialpanel, which abolished the detention against the defendant.A lot of time passed after this when the chairman of the court, who was replacedin the meantime, called me on one occasion and, as I understood,the chairman of the court and district attorney ordered me to go and interrogatedefendant Saša Cvjetan again. This time, it was in Bijelo Polje. Hewas in detention because of some other criminal act. The district attorneysubmitted another investigation order request against him and the presidentof the court ordered me to go and interrogate him once more. He toldme to find a way to go and to go immediately. He did not give me enoughtime to find the court reporter and he told me to hurry up and added thathe would provide everything I needed, with the help of the president of theBijelo Polje Court and that I should take off immediately and interrogatethe defendant. In the meantime the prosecutor changed the qualificationof the criminal act and defined it as an act, which did not require defence.The president of the court told me the same thing. When I arrived to BijeloPolje I told defendant Cvjetan that the defence was not obligatory, butsince he did not have a defence attorney I could go and return when a defenceattorney is provided for him. The defendant, who behaved nicely allthe time, told me that I should stay because there was no need for me togo back. My court reporter, which the court in Bijelo Polje provided, and Iwere present during the interrogation. I cannot remember if I had the investigationorder request with me at the time. Maybe I read it in the car;I think I had this request, but I am not certain. You know, I lot of time haspassed since then and I am not certain about this thing anymore, but as faras I can remember, this is how it was.Later on, the witness was asked whether he was certain that he had theprosecutor’s investigation order request and the witness answered, “I thinkI had the prosecutor’s investigation order request before I interrogated thedefendant in Bijelo Polje because I know that I based my decision regardingthe detention time on this request. Before I went to Bijelo Polje I spoketo Prosecutor Miroslav Nikolić and called him to come with me, but he toldme that I should go alone because he had some other business to do. I usuallycall him because we are also neighbours.232
