Podujevo 1999 – Beyond Reasonable Doubtreturned it was not the same soldier with Shefkate. There were a lot of soldiersoutside. Several of them were standing around Shefkate; they wereyelling; she was crying; and they pushed her. It was not the same person, the one who took her inside the house and who pushed her. I am sayingthis because the one who took her inside was taller than the one whopushed her”.A defence counsellor said he was sorry because of what Saranda and herfamily went through. Goran Rodić asked the witness a question and thewitness said:“We started going out before the soldiers came in because we already sawthem coming”.Since the witness was reminded that during the process of identificationshe said one of the people was around 40 and today she said that this manwas around 30. As a response to this remark, the witness stated that shemeant that day, as well as today, that the man was between 35 and 40years of age.Defendant Saša Cvjetan said he was sorry because of what Saranda and herfamily went through. He had no questions for her and said that he only hadone remark. First of all, he said that he was not in the yard where all of thishappened and it was impossible for somebody to see his face. He addedthat the event took place the way he described during the main hearing inProkuplje and Belgrade.Besides that, he raised objections regarding the process of identificationsaying that his identity was not protected since a photograph of him waspublished in the newspapers several times and the trial in Prokuplje wasbroadcasted. He personally watched the scenes on the Novi Sad TV stationand he possesses the video recordings. He thinks that the identificationprocess should have been undertaken much earlier and, besides this, therewere less people in the photographs shown to the witnesses than therewere people in the unit. Due to that, he thinks that all member of the unitshould have been present during the process of identification in their uniformin order to make the process reliable.145
