This was determinedon the basis of the statement given by witness Sran Manojlović,dated 17 May 2005, wherefrom it follows that, for the needs of the Scorpionsunit, on 27 March 1999, in Prolom Banja, where the unit was stationed,a truck brought 15 cases each containing ten 6.62 mm automatic rifles andammunition. Sran Manojlović signed for the arms and distributed themto the members of the Scorpions unit, without recording serial numbers ofthe automatic rifles before issuing them to the members of the unit.On the same day when the Scorpions unit arrived in Podujevo, in the houseof the Gjata family, located in Podujevo, at No. 174 Kosančić Ivana Street,there were, in addition to the members of the Gjata family and the RexhepKastrati family, members of some other families so that all together, in thiscourtyard, there were some 30 persons. Witness Rexhep Kastrati statedthat that morning when, on hearing noise in the courtyard, he had comedown to the courtyard, there were uniformed men, in about four kinds ofdifferent uniforms. Before witness Kastrati went his sister who was holdingin her hand a 1,000 German mark note. His sister was offering the note toa uniformed person who asked her why she was giving him the note, andthen witness Kastrati, taking the money from her hand, handed it over tothat person, saying: “Its my sister’s treat.” The man took the money andthen levelled the automatic rifle at Kastrati’s chest. That man in a uniformwas the defendant, Saša Cvjetan, whom witness Kastrati had, with certainty,identified at the main trial and provided a detailed description of hisbehaviour. Holding his rifle levelled at Rexhep Kastrati’s chest all the time,the defendant was asking about what was behind the door and where thedoors on the ground floor were leading to, which the witness provided anexplanation for.When the noise was heard, as people from other houses were coming intothe courtyard, the defendant left witness Kastrati and ran away and thenthe witness heard the defendant asking someone: “Saša, what are we goingto do with them?” The whole group, including witness Kastrati, left thecourtyard and went out into the street where the defendant said: “I’ll kill allof you.” He then came up to witness Rexhep Kastrati again, took him awayfrom the group and levelled the automatic rifle at his chest.
