Humanitarian Law CenterWitness Zdravko Smiljić was the first of the witnesses who were members ofthe Scorpions unit to give a detailed description of the chronology of eventsfrom the arrival of the unit in Podujevo to their return to Prolom Banja. Itwas only on the basis of his statement that the court was able to realise thefact that the members of this unit, on that day, had spent around five hoursin Podujevo. Although, on the basis of the statements of other members ofthe Scorpions, it appeared that they had arrived in Podujevo, started lookingfor accommodation and returned, it is still clear that for all the activitiesdescribing the participation of the defendant in the event required a certainamount of time, and that is the detail that has been made clear, except bythe statements of the plaintiffs and the statement of witness Smiljić.This witness, also, stated that, after having found accommodation in aground floor house, he heard some “rather intensive shooting” comingfrom the direction where the first platoon of the Scorpions was stationed.When, together with other men from his house, he arrived to the place theshooting was coming from, he saw people carrying the wounded out ofthe courtyard, while in the street itself he saw ambulances. The witness explainedthat he thought that the first platoon commander was Željko ukićand that he had seen him, Miodrag Šolaja, Goran Stoparić, Dragan Medić,Saša Dabić and the defendant at the lineup in front of the house where thewounded were carried out of. The court has accepted these parts of hisstatement because they fit the description of the event whose elements arethe statements given by other witness and plaintiffs.Witnesses Miodrag Šolaja and Aleksandar Dabić agreed that, upon leavingthe bus, they went into a house, and half an hour later there was shooting,which is why they went out and were told to go toward the buses, whichthey did. Although these witnesses obviously did not want to describe everythingthey had seen and heard that day, the appearance of witness MiodragŠolaja helped clarify the fact that it was him who had been searchingmembers of the Bogujevci family. Beside the description of this fact presentedby witness Goran Stoparić, the very appearance of witness MiodragŠolaja and his age fully agree with the description of the person who hadbeen searching them given by plaintiff Fatos Bogujevci. This detail, andsome other details, corroborate the statements of the plaintiffs and witnessGoran Stoparić and thus confirmed their veracity.314
