Podujevo 1999 – Beyond Reasonable Doubtall this was happening during the state of emergency when police had authorityto keep a person in detention more than 30 days, but still Demirovićand Cvjetan were handed over to the investigative judge, as far as I know,after two days of detention. I do not know how long they were detained inNovi Sad. That was the limiting factor at the time so that the detention didnot exceed three days according to the old law. After the interrogation wemade a criminal complaint and gave it to the Prokuplje Secretariat of Interiorofficers who submitted it, along with the accompanying documentation,to the Prokuplje District Court, i.e. District Prosecutor’s Office. We senta letter to the public prosecutor and to the investigative judge and, right afterwe wrote the criminal complaint, we left.”As an answer to a trial juror’s question, the witness said,“It is true that I had mentioned that I found it strange that the Prokupljedepartment was conducting this task and this happened in Podujevo, but Ifound an explanation in the state of emergency - the bombing. The ProkupljeSecretariat of Interior should have been in charge of this case. Anotherthing was strange. We were supposed to conduct the interrogation andsubmit the criminal complaint. There were other things that needed to bedone, as well, like to find the rifles and other material traces and to undertakethe expertise. We spoke about this to the Prokuplje Public Prosecutorand we expected him to submit the requests in order to obtain necessaryinformation. As far as I know, there were no such requests. I never receivedsuch a document again and I was never again asked to give any informationon this case. I am reminding you that we conducted the whole procedureagainst the defendants very correctly and we treated them as if theywere our colleagues, which means that when we were eating, they wereeating as well; when we drank coffee, they drank coffee as well. We did notthreaten them; we never suggested to them to sign something; they werepersonally writing their statements and we only made grammatical correctionsin order for sentences to have sense.”As an answer to the defence counsellor’s question, the witness said,“I know that the Podujevo Police Station Criminal Department conductedan investigation before we arrived. I want to say that the first investigationwas conducted by the Podujevo police and the second by the Proku-105
