On 18 June 1999 the Prokuplje District Public Prosecutorlodged an appeal against this scandalous ruling, in which the factual backgroundwas falsely presented. The Supreme Court made a ruling Kž II –456/99 on 13 July 1999 by which it upheld the appeal lodged by the ProkupljeDistrict Public Prosecutor and dismissed the Prokuplje District Court’sverdict, by which the investigation into this act was closed and detentionagainst suspects Cvjetan Saša and Demirović Dejan was terminated.More than two years this case spent in a drawer in the Prokuplje DistrictCourt, until 15 November 2001 when defendant Cvjetan Saša was arrestedagain and investigation against him regarding the execution of 14 Albanians,which was committed on 28 March 1999, was opened again, but thistime it was because of the act of war crime against civilian persons pursuantto Article 142 Para 1 of the FRY Criminal Code.The trial of Cvjetan Saša continued only after the Milošević’s regime wasoverturned, the Prokuplje District Court Chairman Branislav . Niketić wasdismissed, and new Serbian Government was formed.The Prokuplje District Public Prosecutor filed an indictment on 5 April2002 against Saša Cvjetan and Demirović Dejan because of the war crimeagainst civilian population pursuant to Article 142 Para 1 of the FRY CriminalCode. Since Demirović ran away to some foreign country in the meantime,his trial was separated from the trial of Cvjetan. The trial of CvjetanSaša began on 9 October 1002 before the Prokuplje District Court TrialPanel presided by Judge Lapčević. In this trial, defendant Cvjetan Sašawithdrew his admission given before Investigative Judge Mijat Bajović on24 May 1999. Since the presence of a Defence Attorney was mandatory,the defendant and his Counsellors demanded that this record be extractedfrom the case file because pursuant to the Criminal Procedure Codeprovisions, it could not be used as evidence. The Presiding Judge of theTrial Panel Comprised of five members, Judge Lapčević, accepted the DefenceCouncil’s proposal to interrogate Investigative Judge Mijat Bajović,his Court Reporter Radica Marinković, and the Head of the Prokuplje DistrictPrison Aleksandar orević, regarding the question whether or notAttorney Dragutin Stanković was present in the interrogation of defendantCvjetan Saša on 24 May 1999 as his ex officio Attorney.
