Clause 8 on independence of the commission proposes that the commission should<br />

not be subject to direction or control of any person or authority in the discharge of its<br />

functions.<br />

Clause 9 gives the quorum of the commission as seven for meetings, nine for hearings<br />

and three for committees.<br />

Clause 10 gives the commission power to regulate its procedure and to apply rules of<br />

natural justice.<br />

15. PART III OF THE BILL- FUNCTIONS OF THE NATIONAL TRUTH AND RECONCILLIATION<br />

COMMISSION<br />

This part comprises clauses 11-13. Clause 11 gives the functions of the Commission like<br />

initiating, facilitating and coordinating inquiries into gross violations of human rights,<br />

receiving evidence, encouraging inter-communal reconciliation, etc.<br />

Clause 12 proposes that the jurisdiction of the commission should be the investigation<br />

and hearing of matters of gross violations of human rights save for those matters before<br />

the International crimes division of the high court, among others.<br />

Clause 13 gives the powers of the commission like summoning any person to attend the<br />

commission or to produce any books or documents in his or her custody, etc.<br />

16. PART IV-SECRETARIAT AND STAFF OF THE COMMISSION<br />

Clauses 14-18 deal with the secretariat of the commission. Clause 14 proposes that the<br />

secretariat should be responsible for the day to day operations of the commission with<br />

functions such as to collect evidence, record statements from any person connected<br />

to a matter, interview any person connected to a matter, etc; the secretariat should be<br />

headed by the executive secretary.<br />

Clause 15, proposes that the executive secretary should be appointed by the Minister on<br />

the recommendation of the commission.<br />

Clause 16 gives the powers of the executive secretary like implementing the policies<br />

and programmes of the commission, managing the funds of the commission, keeping<br />

records of the proceedings of the commission, etc.<br />

Clause 17 gives the commission powers to appoint officers and other staff necessary for<br />

effective performance of its functions; Clause 18 proposes that the Commission may<br />

establish regional offices for purposes of discharging its functions.<br />

17. PART V- HEARINGS AND PROCEDURE OF THE COMMISSION<br />

Clauses 19- 31 deal with the committees of the commission which include the human<br />

rights committee, amnesty committee, reparations committee and any other committee<br />

as may be constituted by the commission.<br />

Clauses 20 and 21 propose that the human rights committee should be composed of a<br />

chairperson and at least three commissioners one of whom a woman. The committee<br />
