19. Committees of the Commission.<br />

For the purposes of discharging the functions of the Commission, the Commission shall<br />

have the following committees –<br />

(d) the human rights committee;<br />

(e) the amnesty committee;<br />

(f) reparation committee;<br />

(g) any other committee that in the opinion of the Commission is expedient and<br />

necessary for the discharge of the functions of the Commission.<br />

Human rights committee<br />

20. Human rights committee<br />

(1) The human rights committee shall be composed of a chairperson and at least three<br />

commissioners, one of whom shall be a woman.<br />

(2) The Commission may co-opt any person with expert knowledge in human rights or<br />

concerning the functions of the Commission to attend and take part in the proceedings<br />

of the investigation committee.<br />

21. Functions and powers of the human rights committee<br />

The human rights committee is responsible for executing the functions of the Commission<br />

specified in section 11(1) (a) and (i) and any other function delegated or assigned to the<br />

committee by the Commission.<br />

Amnesty committee<br />

22. Amnesty committee<br />

(1) The amnesty committee shall be composed of a chairperson and at least three<br />

commissioners, one of whom shall be a woman.<br />

(2) The Commission may co-opt any person with expert knowledge concerning the<br />

functions of the Commission to attend and take part in the proceedings of the committee.<br />

(3) The Amnesty committee is responsible for determining applications for amnesty and<br />

making recommendations to the Commission to grant amnesty to persons in accordance<br />

with this Act.<br />

23. Amnesty<br />

(1) A person is eligible for amnesty if the Commission is satisfied that –<br />

(a) the violation or abuse of human rights committed by the person is within the<br />

mandate of the Commission under this Act;<br />

(b) the violation or abuse of human rights was committed in the cause or<br />

furtherance of a war, conflict or political objective;<br />

(b) the person has made full disclosure of all the facts relevant to the violation or<br />

abuse of human rights.<br />

(2) The Commission shall grant amnesty to an eligible person upon –<br />

(a) the application of the person for amnesty; or<br />

(b) where the person is recommended for the grant of amnesty<br />

by the human rights committee.<br />

(3) In determining an application or recommendation for amnesty the Commission shall<br />
