6. Selection Committee<br />

(1) Parliament shall appoint a selection committee of five persons, at least two of whom<br />

shall be women, for the purposes of identifying and recommending to the President the<br />

persons to be appointed commissioners.<br />

(2) In appointing a selection committee, Parliament shall ensure that the persons<br />

appointed –<br />

(a) reflect a regional balance;<br />

(b) are highly qualified with proven integrity and credibility;<br />

(c) are citizens of diverse professional backgrounds drawn from academia, civil<br />

society organizations, faith based institutions, cultural institutions or other professions;<br />

(d) are non-partisan;<br />

(3) A person shall not be appointed to the Selection Committee who—<br />

(a) has been convicted of an offence involving dishonesty or fraud by a competent<br />

court in Uganda or elsewhere;<br />

(b) is insolvent, or has made any assignment or arrangement with his or her<br />

creditors;<br />

(c) has been convicted of an offence and sentenced to a term of<br />

imprisonment of six months or more by a competent court<br />

in Uganda or elsewhere;<br />

(d) is a Member of Parliament, a Minister or a member of a local<br />

government council;<br />

(e) is a member of the executive committee of a political party or political<br />

organization;<br />

(f) is a member of the Uganda Police Force or Uganda Peoples Defence Forces.<br />

(4) For the purposes of subsection (1), the selection committee shall act in accordance<br />

with Schedule 3.<br />

(5) The selection committee shall stand dissolved after performing its function under<br />

this section.<br />

7. Vacating the office of commissioner.<br />

(1) The office of commissioner shall become vacant if the person holding the office<br />

resigns in writing addressed to the President or is removed from office by the President<br />

only for-<br />

(a) inability to perform the functions of his or her office arising from infirmity of<br />

body or mind;<br />

(b) misbehaviour or misconduct; or<br />

(c) incompetence.<br />

(2) Where the President intends to remove a commissioner from office for misbehaviour<br />

or misconduct, the President shall, before removal, give the commissioner an opportunity<br />

to be heard on the allegations made against him or her.<br />

8. Independence of the Commission.<br />

(1) Subject to this Act, the Commission shall, in the exercise of its functions, be<br />

independent and shall not be subject to the direction or control of any person or<br />

authority.<br />
