(a) keep all information obtained in the strictest confidence;<br />

(b) not release or disclose any information except in accordance with this<br />

Act.<br />

(2) A person who contravenes subsection (1) commits an offence and is liable on<br />

conviction to a fine not exceeding ninety six currency points or imprisonment not<br />

exceeding forty eight months or both.<br />

40. Entry, search or seizure upon warrant<br />

(1) Every entry upon premises, inspection, search or seizure under this Act shall be made<br />

upon a warrant issued in accordance with this Act.<br />

(2) A warrant shall be issued by the chairperson and shall specify the premises to be<br />

inspected or searched or the articles, documents to be seized.<br />

(3) The chairperson shall specify the person to execute the warrant and the time between<br />

8a.m and 5 p.m when the warrant shall be executed.<br />

(4) A person executing a warrant under this section shall at the time of executing the<br />

warrant identify themselves.<br />

(5) A person executing a warrant under this section shall be accompanied by a police<br />

officer who may use reasonable force to execute the warrant.<br />

(6) A person who enters or inspects premises or seizes any article or document without<br />

a warrant commits an offence and is liable on conviction to a fine not exceeding forty<br />

eight currency point or imprisonment not exceeding twenty four months or both.<br />

Reports and implementation<br />

41. Reports<br />

(1) The Commission may, at any time, when requested to do so or on its own accord,<br />

submit to the Minister, a report on any matter arising during the performance of the<br />

functions of the commission under this Act.<br />

(2) The Commission shall within three months after the conclusion of its activities under<br />

this Act, make and submit a final report to the President and Parliament.<br />

(3) The reports under this section shall specify how the Commission has discharged each<br />

of the functions in section 11 and shall include –<br />

(a) details of the Commission’s work, including investigations, hearings, and<br />

findings, including -<br />

(i) the nature of investigations, the number of persons investigated;<br />

(ii) the number of persons who applied or were recommended for amnesty;<br />

(iii) the number of persons granted amnesty;<br />

(iv) the number of victims, including those who did not appear before the<br />

Commission;<br />

(v) the nature of human rights violations or abuses and their impact on the public;<br />

(b) the conclusions regarding the needs of victims, as well as recommendations<br />

regarding public memorials and prosecution;<br />

(c) recommendations for reparation of victims;<br />

(d) recommendations regarding the steps that should be taken, including new<br />

legislation, changes in government policy and amendments to the law, to prevent the<br />

occurrence of the violations and abuses of human rights in future;<br />

(e) the strategy that should be taken to implement the recommendations of the<br />

Commission, including identifying the responsible ministry, institution or agency.<br />
