Clause 34 proposes that commission should be a self accounting body with power to<br />

deal directly with the Ministry responsible for finance.<br />

Clause 35 gives the financial year of the commission as a period of twelve months from<br />

1st July to 30th June of the following year.<br />

Clause 36 proposes that the commission should submit estimates of income and<br />

expenditure to the minister within three months before the commencement of each<br />

financial year.<br />

Clause 37 proposes that the commission should keep proper books of accounts which<br />

must be periodically audited by the auditor general.<br />

19. PART VII- GENERAL<br />

This part contains general provisions relating to the operation of the Act. For instance<br />

under clause 38 a commissioner who has an interest in a matter before the commission<br />

shall disclose his or her interest and shall not take part in the proceedings and where a<br />

commissioner does not disclose conflict of interest, all decisions affected by the conflict<br />

of interest shall be reviewed without the participation of the commissioner concerned.<br />

Clause 39 creates an offence for whoever discloses information obtained in course of<br />

duty.<br />

Clause 40 proposes that entry, search or seizure should be upon a warrant signed by the<br />

chairperson.<br />

Clause 41 spells out the reporting requirements of the commission.<br />

Clause 42 proposes that the President with the approval of Parliament should establish a<br />

framework to implement the report and recommendations of the commission.<br />

This part also deals with appeals to the High court against decisions of the commission,<br />

protection of members and officers of the commission from liability for acts done<br />

or omitted to be done in good faith, penalty for interference with the work of the<br />

commission, application of existing laws relating to facilitation and promotion of national<br />

peace and reconciliation with necessary modification and power to make regulations to<br />

give effect to the Act.<br />

20. SCHEDULES<br />

The Bill has 4 schedules.<br />

Schedule one deals with the currency point which is equivalent to twenty thousand<br />

shillings only.<br />

Schedule two proposes the criteria for selection of the commissioners by the selection<br />

committee.<br />
