ased on factual and objective information and evidence collected or received by it ;<br />

(k) to make recommendations to the President regarding -<br />

(i) the measures to take in making reparation to victims of gross human rights<br />

violations or abuses;<br />

(i) the rehabilitation of perpetrators taking into account their needs for psychosocial<br />

or other rehabilitative services;<br />

(ii) the creation of institutions conducive to a stable and fair society and the<br />

institutional, administrative and legislative measures which may be taken or introduced<br />

in order to prevent the commission of gross violations or abuses of human rights;<br />

(l) to perform any other function related to or consequential to the functions<br />

under this Act or conferred by Parliament.<br />

(2) The Commission shall, to the greatest extent possible, and consistent with this Act,<br />

consult and co-operate with departments, branches and agencies of the Government<br />

having duties, aims or objectives related to those of the Commission.<br />

(3) In the performance of its functions, the Commission may seek the assistance of<br />

traditional, cultural or religious leaders to facilitate the public sessions held by the<br />

Commission or to assist in the reconciliation programmes of the Commission.<br />

12. Jurisdiction of the Commission<br />

(1) The Commission shall investigate, determine and make recommendations on all<br />

matters involving gross violations or abuses of human rights within its functions and to<br />

which this Act applies.<br />

(2) The Commission shall not investigate or deal with —<br />

(a) any matter which is pending before a court or judicial tribunal or is under<br />

investigation by another public institution unless the court or other institution adjourns<br />

its proceedings in order for investigations or proceedings to take place under this Act;<br />

(b) a matter involving the relations or dealings between the Government of Uganda<br />

and the government of any foreign state or international organization;<br />

(c) a matter relating to the exercise of the prerogative of mercy under article 121<br />

of the Constitution;<br />

(3) For the avoidance of doubt, the Commission shall not hear or determine any matter<br />

before the International Crimes Division of the High Court.<br />

13. Powers of the Commission.<br />

(1) In the performance of its functions under this Act, the Commission has the powers<br />

of a court to—<br />

(a) require the attendance before the Commission of any person, including a<br />

person who has been pardoned, convicted, acquitted or granted amnesty ;<br />

(b) require the production of any books, papers or documents;<br />

(c) inspect any books, papers, materials or documents produced<br />

before the commission or otherwise and—<br />

(i) retain the books, papers, materials, or documents for a reasonable period as<br />

the Commission shall determine; or<br />

(ii) make copies of any of them, or their contents;<br />

(d) require any person to take or subscribe to an oath or affirmation to speak<br />

truthfully to the Commission and to respond to all questions put by members of the<br />
