shall be dosignated by <strong>the</strong> superintendent or foreman to be at <strong>the</strong>ir<br />

proper places from <strong>the</strong> time that persons begin to descend, until all<br />

<strong>the</strong> i^ersons who may be at <strong>the</strong> bottom <strong>of</strong> said shaft or slope when<br />

quitting work shall be hoisted. Such headman and footman shall<br />

personally attend to<br />

<strong>the</strong> sigmils and see that <strong>the</strong> provisions <strong>of</strong> this<br />

act, in i'esj)ect to lowering and hoisting persons in shafts or slopes,<br />

shall be complied with.<br />

Rule 41. No person, excei^t <strong>the</strong> man giving <strong>the</strong> signal, shall jump<br />

on a car, cage or gunboat after <strong>the</strong> signal to start has been given,<br />

and if any person should enter a car, cage or gunboat in excess <strong>of</strong><br />

<strong>the</strong> lawful uumber <strong>the</strong> headman or footman shall notify him <strong>of</strong> <strong>the</strong><br />

fact and request him to get <strong>of</strong>f, which request must be immediately<br />

complied with. Any violation <strong>of</strong> this rule must be reported promptly<br />

to <strong>the</strong> mine foreman.<br />

Kule 42. An empty trip shall be hoisted in any shaft or slope where<br />

<strong>the</strong> engine has been standing idle for an hour or more, before men<br />

are hoisted or low'ered in said shafts or slopes, and no person or persons<br />

shall ascend any shaft or slope when working on <strong>the</strong> night turn,<br />

until one trip shall first be hoisted <strong>the</strong>rein.<br />

Kule 43. Every passage-way used by persons in any mines and<br />

also used for transportation <strong>of</strong> coal or o<strong>the</strong>r material, shall be made<br />

<strong>of</strong> sufficient width to permit persons to pass moving cars with<br />

safety, but if<br />

found impracticable to make any passage-way <strong>of</strong> sufficient<br />

width, <strong>the</strong>n holes <strong>of</strong> ample dimensions, and not more than one<br />

hundred and fifty (150) feet apart, shall be made on one side <strong>of</strong> said<br />

passage-wa}'. The said jjassage-way and safety holes shall be kept<br />

free from obstructions and shall be well drained;<br />

<strong>the</strong> ro<strong>of</strong> and sides<br />

<strong>of</strong> <strong>the</strong> same shall be made secure.<br />

Kule 44. When locomotives are used in any mine <strong>the</strong>ir speed shall<br />

not exceed six (G) miles per hour, and an efficient alarm shall be provided<br />

and attached to <strong>the</strong> front end <strong>of</strong> every train <strong>of</strong> cars pushed by<br />

a locomotive in any mine or part <strong>of</strong> a mine.<br />

Kule 45. Locomotives propelled by steam, if using fire, shall not be<br />

used in any passage-way which is also used as an intake air-way to<br />

any mine or part <strong>of</strong> a mine where persons are employed, unless <strong>the</strong>re<br />

be a suffiecient quantity <strong>of</strong> air circulating <strong>the</strong>rein to maintain a<br />

healthy atmosphere.<br />

Kule 46. No person shall couple or uncouple loaded or empty cars<br />

while <strong>the</strong> same are in motion: Provided however, That this shall not<br />

apply to <strong>the</strong> top or bottom men <strong>of</strong> sloi)es, ])lanes or shafts.<br />

Rule 47. When cars are run on gravity roads by breaks or sprags,<br />

<strong>the</strong> runner shall only ride on <strong>the</strong> rear end <strong>of</strong> <strong>the</strong> last car, and when<br />

said cars are run by sprags, a space <strong>of</strong> not less than two (2) feet from<br />

<strong>the</strong> body <strong>of</strong> <strong>the</strong> car shall be made on one or both sides <strong>of</strong> <strong>the</strong> tracJ-'.<br />
