under bim, or iii <strong>the</strong> mines under his charge and supervision<br />

as a miner, who does not hold such certificates. Any person<br />

or persons who sliall violate or fail to comply with<br />

<strong>the</strong> provisions <strong>of</strong> this act, shall be guilty <strong>of</strong> a misdemeiinor,<br />

and on conviction <strong>the</strong>re<strong>of</strong> shall be sentenced to pay a fine not less<br />

than one hundred dollars and not to exceed five hundred dollars, or<br />

shall undergo imprisonment for a term not less than thir(y days and<br />

not to exceed six months, or ei<strong>the</strong>r, or both, at <strong>the</strong> discretion <strong>of</strong><br />

<strong>the</strong> court.<br />

Section 7.<br />

The persons who are now serving as members <strong>of</strong> <strong>the</strong><br />

Miners' Examining Board as created by <strong>the</strong> act approved <strong>the</strong> ninth<br />

day <strong>of</strong> May, Anno Domini one thousand eight hundred and eightynine,<br />

entitled ''An act to provide for <strong>the</strong> examination <strong>of</strong> miners in<br />

<strong>the</strong> anthracite region <strong>of</strong> this Commonwealth, and to prevent <strong>the</strong><br />

employment <strong>of</strong> incompetent persons as miners in anthracite coal<br />

mines," shall continue under <strong>the</strong> provisions <strong>of</strong> this act to serve as<br />

members <strong>of</strong> <strong>the</strong> ''Miners' Examining Board" until <strong>the</strong> terms for<br />

which <strong>the</strong>y were appointed under <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> said act a})-<br />

proved <strong>the</strong> ninth da^^ <strong>of</strong> May, Anno Domini one thousand eight hundred<br />

and eight^'-nine, shall have expired, and in <strong>the</strong> performance<br />

<strong>of</strong> <strong>the</strong> duties <strong>of</strong> <strong>the</strong>ir <strong>of</strong>fice <strong>the</strong>y shall be subject to <strong>the</strong> provisions and<br />

requirements <strong>of</strong> this act.<br />

Section 8. Nothing in this act shall be construed to in any way,<br />

excepting as herein provided, effect miners' certificates which have<br />

been lawfully issued under <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> herein mentioned<br />

act, approved <strong>the</strong> ninth day <strong>of</strong> May, Anno Domini one thousand eight<br />

hundred and eighty-nine.<br />

It shall be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> several Miners' Examining Boards<br />

to investigate all<br />

complaints or charges <strong>of</strong> non compliance or viola<br />

tion <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> this act. and to prosecute all })ersons so<br />

<strong>of</strong>i'ending; and upon <strong>the</strong>ir failure so to do, <strong>the</strong>n it shall become <strong>the</strong><br />

duty <strong>of</strong> <strong>the</strong> district<br />

attorney <strong>of</strong> <strong>the</strong> county wherein <strong>the</strong> complaints<br />

or charges are made to investigate <strong>the</strong> same and prosecute all pei'-<br />

sons so <strong>of</strong>fending, and it shall at all times be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> district<br />

attorney to prosecute such members <strong>of</strong> <strong>the</strong> Miners' Examining Board<br />

as haA'e failed to perform <strong>the</strong>ir duty under <strong>the</strong> provisions <strong>of</strong> this<br />

act; but nothing herein contained shall prevent any citizen, a resident<br />

<strong>of</strong> this Oommonwealth, from prosecuting any person or i)ersons violating<br />

this act, with power to emi)lov private counsel to assist in <strong>the</strong><br />

])rosecution <strong>of</strong> <strong>the</strong> same; ui)on conviction <strong>of</strong> any member <strong>of</strong> <strong>the</strong><br />

Miners' Examining Board for any violation <strong>of</strong> this mi\ in addition<br />

to <strong>the</strong> i)enalties herein provided, his <strong>of</strong>fice shall be declared vacant,<br />

and he shall be deemed ineligible lo act as a member <strong>of</strong> Jhe said<br />

board.
