writing, <strong>of</strong> such adjourned inquest, and <strong>the</strong> time and place <strong>of</strong> holding<br />

<strong>the</strong> same, at least three (3)<br />

days previous <strong>the</strong>reto.<br />

Section 4. Due notice <strong>of</strong> an intended inquest to be held by <strong>the</strong><br />

coroner, shall be given by tlie coroner to <strong>the</strong> inspector, and at any<br />

such inquest <strong>the</strong> inspector shall have <strong>the</strong> right to examine witnesses.<br />

Section 5. If, at any inquest held over <strong>the</strong> body or bodies <strong>of</strong> persons<br />

whose death was caused by an accident in<br />

or about a mine or<br />

colliery, <strong>the</strong> inspector be not present, and it is shown by <strong>the</strong> evidence<br />

given at <strong>the</strong> inquest that <strong>the</strong> accident was caused by neglect<br />

or by any defect in or about <strong>the</strong> mine or colliery, which in <strong>the</strong> judgment<br />

<strong>of</strong> <strong>the</strong> jury, requires a remedy, <strong>the</strong> coroner shall send notice<br />

in writing to said inspector <strong>of</strong> such neglect or default.<br />

Section 0. No person who is interested personally, nor a person<br />

employed in <strong>the</strong> mine or at a colliery in or at which loss <strong>of</strong> life has<br />

occurred by accident, shall be qualified to serve on a jury empaneled<br />

on <strong>the</strong> inquest, and a constable or o<strong>the</strong>r <strong>of</strong>ficer shall not summons<br />

such a person so qualified as juror, but <strong>the</strong> coroner shall empanel a<br />

majorit}' <strong>of</strong> <strong>the</strong> jury from miners who are qualified to judge <strong>of</strong> <strong>the</strong><br />

nature <strong>of</strong> <strong>the</strong> accident; every person who fails to comply with <strong>the</strong><br />

provisions <strong>of</strong> this article shall be guilty <strong>of</strong> an <strong>of</strong>fense against this<br />

act.<br />

ARTICLE XIV.<br />

Returns, Notices,<br />

Et Cetera.<br />

Section 1.<br />

Notices <strong>of</strong> death or serious injuries resulting from accidents<br />

in or about mines or collieries, shall be made to <strong>the</strong> inspector<br />

<strong>of</strong> mines, in writng, and shall specify <strong>the</strong> name, «ge and occupation<br />

<strong>of</strong> <strong>the</strong> person killed or injured, and also <strong>the</strong> nature and character<br />

<strong>of</strong> <strong>the</strong> accident and <strong>of</strong> <strong>the</strong> injury caused <strong>the</strong>reby.<br />

Section 2. The owner, operator or superintendent <strong>of</strong> a mine or colliery,<br />

shall, without delay, give notice to<br />

<strong>the</strong> inspector <strong>of</strong> <strong>the</strong> district<br />

in which said mine or colliery is situated in any or all <strong>of</strong> <strong>the</strong> following<br />

cases:<br />

First, ^\'here any working is commenced for <strong>the</strong> purpose <strong>of</strong> opening<br />

a new slope or mine to which this act applies.<br />

Second. Where any mine is abandoned or <strong>the</strong> workings <strong>the</strong>re<strong>of</strong><br />

discontinued.<br />

Third, ^^'ll(•re <strong>the</strong> working <strong>of</strong> any mine is recommenced after any<br />

abandonment or discontinuance for a period exceeding three mouths.<br />

Fourth. 'Wiiere any new coal breaker is com|»leted and work commenced<br />

<strong>the</strong>rein for <strong>the</strong> f)urpose <strong>of</strong> preparing coal for market.<br />

Fifth. Wlu'rc I he pillnrs <strong>of</strong> a mine are to be removed or robbed.<br />

Sixth. ^Vhere a squeeze or crush or any o<strong>the</strong>r cause or change<br />

may seem to atfect <strong>the</strong> safety <strong>of</strong> persons employed in any mine,<br />

or where fiie occuis or a dangi-rous body <strong>of</strong> gas is found in any<br />

mine.
