67.23 COMPREHENSIVE DEVELOPMENT DISTRICT NO. 33 [CD NO. 33]In that zone designated as CD No. 33 [Comprehensive Development District No. 33], noBuilding or Structure or part there<strong>of</strong> shall be erected, constructed, placed, maintained orused and no land shall be used except in accordance with and subject to the regulationscontained in or incorporated by reference to this Part.(1) Permitted UsesThe following uses and no others shall be permitted:(a)Apartment Use(2) Parcel SizeThe minimum Parcel Size <strong>of</strong> fee simple Parcels created by subdivision shall be 1990square metres.(3) Number <strong>of</strong> BuildingsNot more than one [1] Apartment Building shall be erected, constructed, placed ormaintained on any one Parcel <strong>of</strong> land.(4) Floor AreaNo Apartment Building shall have a Floor Area in excess <strong>of</strong> 2985 square metres.For the purpose <strong>of</strong> calculating lot coverage, that Area <strong>of</strong> Lot 1, Section 11, <strong>Esquimalt</strong>District, Plan VIP 72764 that has been dedicated for park use is included in theParcel Area.(5) Lot CoverageAll Principal Buildings, Accessory Buildings and Structures combined shall not covermore than 45% <strong>of</strong> the Area <strong>of</strong> Lot 8, Section 21, <strong>Esquimalt</strong> District, Plan 2538. Forthe purpose <strong>of</strong> calculating lot coverage, that Area <strong>of</strong> Lot 8, Section 21, <strong>Esquimalt</strong>District, Plan 2538 which has been dedicated for park use is included in the ParcelArea.(6) Building HeightNo part <strong>of</strong> any Building shall exceed 13.0 metres in Height.(7) Number <strong>of</strong> Dwelling UnitsThe maximum number <strong>of</strong> Dwelling Units on Lot 8, Section 21, <strong>Esquimalt</strong> District Plan2538 shall be 40.(8) Siting Requirements(a)Residential Buildings
