67.28 COMPREHENSIVE DEVELOPMENT DISTRICT NO. 39 [CD NO. 39]In that Zone designated as CD No. 39 [Comprehensive Development District No. 39] noBuilding or Structure or part there<strong>of</strong> shall be erected, constructed, placed, maintained, orused and no land shall be used except in accordance with and subject to the regulationscontained in or incorporated by reference into this Part.(1) Permitted UsesThe following Uses and no others shall be permitted:(a)(b)Townhouse ResidentialHome Occupation(2) Parcel SizeThe Minimum Parcel size <strong>of</strong> fee simple parcels created by subdivision shall be 9000square metres.(3) Number <strong>of</strong> Dwelling UnitsThe maximum number <strong>of</strong> Dwelling Units shall not exceed 30.(4) Lot CoverageAll Buildings and Structures combined shall not cover more than 35% <strong>of</strong> the Area <strong>of</strong>the Parcel.(5) Floor Area RatioThe Floor Area Ratio shall not exceed .40.(6) Building Height(a)(b)No Principal Building shall exceed a Height <strong>of</strong> 7.75 metres.No Accessory Building shall exceed a Height <strong>of</strong> 3.6 metres.(7) Siting Requirements(a)Residential Buildings:(i)No Principal Building shall be located within 4.5 metres <strong>of</strong>the south lot line.(ii)No Principal Building shall be located within 7.0 metres <strong>of</strong> thesouthwest lot line.
