normal satisfactory operation, which will be witnessed and accepted by acompetent committee to be constituted by the BPDB.c) 10% payment of the relevant services (inspection/overhauling) may bemade to the LTSA provider after successful completion of at least 1 (one)year warranty period counted from provisional acceptance certificate(PAC). Final acceptance certificate (FAC) will be issued by a competentcommittee constituted by the BPDB.d) 10% performance security of the relevant services will be released afterthe issuance of FAC by a Committee to be constituted by the BPDB.Payment against supply of spares / equipment (inspection/overhauling)will be made as follows:-a) 90% payment of the submitted invoice of the respective supply shall bemade to the LTSA provider against submission of shipping document (Billof lading, packing list, manufacturer's test certificate, country of origin,etc.,) of the relevant supply of spares / equipment to the Power Plantauthority.b) 10% payment of the submitted invoice of the respective supply shall bemade to the LTSA provider after receipt and inspection (R & I) of thespares/ equipment at plant site by the Plant Manager.c) 10% performance security of the relevant supply will be released after theissuance of FAC by a Committee to be constituted by the BPDB.16. CONTRACT:a) Contract signing: Contract will be signed separately for each of theindividual services along with relevant supply of spares againstinspection/overhauling of units/BOP.b) Contract effectiveness: The contract shall come into force from the date ofreceiving confirmed unconditional & irrevocable Bank Guarantee againstpredominance security @ 10% of quoted price of the service and supply ofspares to be required for the units’/BOPs’ scheduled maintenanceimmediately after expiry of EPC contractor's warranty period.Subsequent Bank Guarantees against performance security for next scheduledmaintenances (inspection/overhauling of units and other BOP maintenanceservices) shall be cascaded accordingly in order to maintain the LTSA contract'seffectiveness and continuity during the whole period (4 years) of LTSA.LTSA provider's personnel shall be available in Dhaka, Bangladesh withinmaximum 1 (one) week from the date of receipt of request from the competentauthority of BPDB after the contract is made effective.Ghorasal 200 MW to 300 MW Gas Turbine Peaking Power Plant Project (Vol-2 of 3)221
