2.3. Mechanisms for coping with difficult situations<br />
experienced by <strong>children</strong> <strong>and</strong> <strong>elderly</strong><br />
Children<br />
• Legal<br />
The complexity <strong>of</strong> the migration phenomenon <strong>and</strong> its consequences on<br />
<strong>children</strong>’s wellbeing, require concrete me<strong>as</strong>ures to be taken in order to<br />
mitigate the negative impact <strong>of</strong> migration on <strong>children</strong> <strong>left</strong> <strong>behind</strong>:<br />
- To ensure constant attention <strong>of</strong> all institutions in charge <strong>of</strong> issues<br />
related to <strong>children</strong> <strong>left</strong> <strong>behind</strong> <strong>as</strong> a consequence <strong>of</strong> migration, including<br />
with the implementation <strong>of</strong> “National Action Plan on the<br />
protection <strong>of</strong> <strong>children</strong> <strong>left</strong> without parental care for 2010-2011”<br />
(approved by Government Decision <strong>of</strong> the Republic <strong>of</strong> <strong>Moldova</strong><br />
no.450 <strong>of</strong> 2.06.2010). Although the leadership <strong>of</strong> “National Action<br />
Plan” is ensured by the Government <strong>of</strong> the Republic <strong>of</strong> <strong>Moldova</strong>,<br />
each ministry h<strong>as</strong> its duties. Still ministries do not have the possibility<br />
to, nor should they interfere in every particular situation. Only<br />
through a viable partnership can good results be ensured, more<br />
than that “...we have particular institutions that have this responsibility.<br />
Among the most important ministries’ duties we enlist the analysis<br />
<strong>of</strong> the situation, the regulatory framework amendment <strong>and</strong> its enforcement”<br />
(III_EC_1);<br />
- To improve the legal framework regarding the obligatory appointment<br />
<strong>of</strong> a legal representative for <strong>children</strong> <strong>left</strong> <strong>behind</strong> <strong>as</strong> a consequence<br />
<strong>of</strong> migration: “guardianship should be compulsory for these<br />
<strong>children</strong> <strong>as</strong> should making <strong>of</strong>ficially responsible those who accepted to<br />
take care <strong>and</strong> educate these <strong>children</strong>” (III_EC_2);<br />
- To improve the framework on legal employment abroad, to sign<br />
bilateral agreements that will facilitate communication between parents<br />
<strong>and</strong> <strong>children</strong> <strong>left</strong> <strong>behind</strong> ensuring parents will have the possibility<br />
to see their <strong>children</strong> without risking to lose their jobs;<br />
- To continuously develop forms <strong>of</strong> protection <strong>of</strong> families <strong>and</strong> <strong>children</strong><br />
in difficulty <strong>as</strong> a consequence <strong>of</strong> migration: “at present <strong>Moldova</strong><br />
allocates about 13% <strong>of</strong> its GDP to social <strong>as</strong>sistance programmes, so we<br />
can’t say we lack financial support, but still there is a lot to do regarding<br />
the efficient management <strong>of</strong> these resources. The Law on Social Aid h<strong>as</strong><br />
been operating for 2 years <strong>and</strong> this benefit is given b<strong>as</strong>ed on a <strong>needs</strong> <strong>as</strong>sessment.<br />
There are certain problems in management hence we can say<br />
that 68% <strong>of</strong> allocated funds are directed to the poorest <strong>of</strong> the population.<br />
We will continue this system in future. Only in this way can we talk <strong>of</strong><br />
