38, Documentos Oficiales del Estado del Perú concernientes al operativo presentados ante la
Comisión Inter-Americana en respuesta a la denuncia en este caso, muestran que a pesar de la
negación por parte del Estado de haber usado fuerza armada unilateral contra los prisioneros
el 6 de mayo de 1992, la referencia hecha por la Fiscal de la Nación en dichos documentos
donde llama al operativo 'incursión' y no 'operativo de traslado' es revelador. 101 Muestra
que todas las oficinas estaban concientes que la 'disposición' para 'retomar' o 'reganar el
control' de las prisiones era -como el significado de 'incursión' indica 'un ataque
sorpresivo' 102 en los pabellones lA y 4B.
39 De allí que los diferentes reportes preparados por la Oficina de Nélida Colán y
presentados ante la Comisión Inter-Americana por el Estado del Perú muestran que
a) El Operativo "Mudanza 1" fue implementado de conformidad con una orden del
Ejecutivo.
b) Hubo una cadena de comando en las fuerzas empleadas en dicho operativo quienes
respondían últimamente al Ejecutivo encabezado por Alberto Fujimori (ver la alusión de
Nelida Colán a su coordinación con los 'oficiales a cargo del operativo')
e) Este fue un súbito ataque o incursión en los pabellones l A Y4B
d) Este incluyó la participación de doctores, jueces y Fiscales en apoyo a la
'incursión' del 6 de mayo de 1992.
