The company still maintains that the levels of HCB found in the blood<br />
of the workers do not pose risk and that there is no clinical evidence<br />
showing that the irregular organochlorine deposits have caused any<br />
harm to the workers. According to Rhodia, the levels of HCB found<br />
in fish in the region are not high enough to prevent human<br />
consumption.<br />
Legal outcome In 1993, the company, the Public Prosecutor and the workers made<br />
a deal that guaranteed that the workers would have job stability for<br />
an initial period of four years and that they would have lifelong health<br />
care 59 . The company was also forced to treat their groundwater and<br />
monitor the illegal landfills.These actions have cost Rhodia 20 million<br />
dollars 60 .<br />

statement<br />
Only two workers from Rhodia have been compensated after filing<br />
legal suits, both for having been contaminated in the 1970’s, when<br />
the company still worked with pentachlorophenol. In one of the<br />
cases, the compensation has been paid to the widow in the last 5<br />
years 61 .<br />
Four legal suits were filed against Rhodia in the Baixada Santista<br />
region, one of them in Itanhaém, another in São Vicente and the<br />
other two in Cubatão 62 . To this date, there is still activity on the legal<br />
front.<br />
The company has shown a complete lack of responsibility towards<br />
the community, workers and environment. Rhodia has not been<br />
made liable for a great part of the damage caused to the<br />
environment and to the people. The company has not offered any<br />
compensation or health assistance to the community. There are<br />
people still living in some of the contaminated areas. The behaviour<br />
of the company towards the community and the workers is indicates<br />
the need for a global accountability/liability instrument.<br />
