Applications for mining rights
1219. Adv H C SCHMIDT (DA) asked the
Minister of Minerals and Energy:
With reference to her reply to Question
653 on 17 July 2008, how many applications
for (a) prospecting rights, (b) mining
(i) rights and (ii) permits and (c) conversions
of (i) prospecting and (ii) mining
rights did her department return to the
applicants after acceptance of the application
for purposes of (aa) further details,
(bb) information and/or (cc) completion
submitted in terms of the Mineral and
Petroleum Resources Development Act,
Act 28 of 2002? NW1963E
The MINISTER OF MINERALS AND
ENERGY:
The department does not return applications
to applicants after acceptance. Applications
are only returned to applicants if they were
rejected. After acceptance the department as
stipulated in the Act, has to inform the
applicant of such acceptance, and request the
applicant to consult with interested and
affected parties, submit the results of such
consultation and to submit an Environmental
Management Plan/Programme within the
specified timeframes.
Legal cost of arbitration
1221. Adv H C SCHMIDT (DA) asked the
Minister of Minerals and Energy:
What is the Government’s total legal costs
to date in terms of (a) South African and
(b) international legal costs arising out of
the international arbitration proceedings
(details furnished) instituted by certain
companies (names furnished) on
1 November 2006 against the Government
under certain bilateral investment
treaties (details furnished)? NW1965E
The MINISTER OF MINERALS AND EN-
ERGY:
The Government of the Republic of South
Africa is being represented in the abovementioned
arbitration proceedings by the Office
of the State Attorney in Pretoria, who has
been instructed herein by the Department of
Trade and Industry and the Department of
Minerals and Energy. On instructions of the
abovementioned government departments, the
State Attorney has appointed an international
law firm and a local Counsel to advise and
assist the Government in this matter. The State
Attorney has advised the department that in
respect of (a) South African legal cost is
R1 547 272,25 and (b) international legal cost
is R4 000 000.
Use of departmental vehicle
1386. Mr J SELFE (DA) asked the Minister
of Correctional Services:
(1) Whether his department has conducted
an investigation or intends investigating
the use of a departmental vehicle
(details furnished) which was parked
across two disabled parking bays (details
furnished); if not, what is the
position in this regard; if so, who used
the vehicle;
