Applications for mining rights<br />

1219. Adv H C SCHMIDT (DA) asked the<br />

Minister <strong>of</strong> Minerals and Energy:<br />

With reference to her reply to Question<br />

653 on 17 July 2008, how many applications<br />

for (a) prospecting rights, (b) mining<br />

(i) rights and (ii) permits and (c) conversions<br />

<strong>of</strong> (i) prospecting and (ii) mining<br />

rights did her department return to the<br />

applicants after acceptance <strong>of</strong> the application<br />

for purposes <strong>of</strong> (aa) further details,<br />

(bb) information and/or (cc) completion<br />

submitted in terms <strong>of</strong> the Mineral and<br />

Petroleum Resources Development Act,<br />

Act 28 <strong>of</strong> 2002? NW1963E<br />

The MINISTER OF MINERALS AND<br />

ENERGY:<br />

The department does not return applications<br />

to applicants after acceptance. Applications<br />

are only returned to applicants if they were<br />

rejected. After acceptance the department as<br />

stipulated in the Act, has to inform the<br />

applicant <strong>of</strong> such acceptance, and request the<br />

applicant to consult with interested and<br />

affected parties, submit the results <strong>of</strong> such<br />

consultation and to submit an Environmental<br />

Management Plan/Programme within the<br />

specified timeframes.<br />

Legal cost <strong>of</strong> arbitration<br />

1221. Adv H C SCHMIDT (DA) asked the<br />

Minister <strong>of</strong> Minerals and Energy:<br />

What is the Government’s total legal costs<br />

to date in terms <strong>of</strong> (a) <strong>South</strong> <strong>Africa</strong>n and<br />

(b) international legal costs arising out <strong>of</strong><br />

the international arbitration proceedings<br />

(details furnished) instituted by certain<br />

companies (names furnished) on<br />

1 November 2006 against the Government<br />

under certain bilateral investment<br />

treaties (details furnished)? NW1965E<br />

The MINISTER OF MINERALS AND EN-<br />

ERGY:<br />

The Government <strong>of</strong> the Republic <strong>of</strong> <strong>South</strong><br />

<strong>Africa</strong> is being represented in the abovementioned<br />

arbitration proceedings by the Office<br />

<strong>of</strong> the State Attorney in Pretoria, who has<br />

been instructed herein by the Department <strong>of</strong><br />

Trade and Industry and the Department <strong>of</strong><br />

Minerals and Energy. On instructions <strong>of</strong> the<br />

abovementioned government departments, the<br />

State Attorney has appointed an international<br />

law firm and a local Counsel to advise and<br />

assist the Government in this matter. The State<br />

Attorney has advised the department that in<br />

respect <strong>of</strong> (a) <strong>South</strong> <strong>Africa</strong>n legal cost is<br />

R1 547 272,25 and (b) international legal cost<br />

is R4 000 000.<br />

Use <strong>of</strong> departmental vehicle<br />

1386. Mr J SELFE (DA) asked the Minister<br />

<strong>of</strong> Correctional Services:<br />

(1) Whether his department has conducted<br />

an investigation or intends investigating<br />

the use <strong>of</strong> a departmental vehicle<br />

(details furnished) which was parked<br />

across two disabled parking bays (details<br />

furnished); if not, what is the<br />

position in this regard; if so, who used<br />

the vehicle;<br />

(2) whether any disciplinary action has<br />

been taken against the individual/s us-
