The MINISTER OF DEFENCE:<br />

(1) The Presidential Proclamation No 21<br />

dated 10 February 2004 transferred the<br />

functions regarding the National Key<br />

Points Act, Act 102 <strong>of</strong> 1980 from the<br />

Minister <strong>of</strong> Defence to the Minister <strong>of</strong><br />

Safety and Security in terms <strong>of</strong> section<br />

97 <strong>of</strong> the Constitution, Act 10 <strong>of</strong> 2006.<br />

Prior to the transfer <strong>of</strong> the function, the<br />

SANDF conducted two inspections per<br />

annum at each <strong>of</strong> the national key<br />

points. Where indicated, findings <strong>of</strong><br />

such inspections were presented on a<br />

monthly basis to the National Key<br />

Points Committee for rectification. Representation<br />

on the Committee included<br />

inter alia <strong>of</strong>ficials from departments<br />

responsible for the various national key<br />

points.<br />

(2) At the time <strong>of</strong> the function transfer to<br />

the Department <strong>of</strong> Safety and Security,<br />

the SANDF personnel responsible for<br />

executing the function and all relevant<br />

documentation were transferred to the<br />

<strong>South</strong> <strong>Africa</strong>n Police Services. It is not<br />

possible, therefore, for the SANDF to<br />

provide feedback on the nature <strong>of</strong><br />

specific problems that were encountered<br />

nor what actions have been taken.
