Inadequate road infrastructure to<br />

handle heavy vehicles<br />

1632. Mrs C DUDLEY (ACDP) asked the<br />

Minister <strong>of</strong> Transport:<br />

(1) Whether he has been informed <strong>of</strong><br />

concerns <strong>of</strong> communities (details<br />

furnished) regarding inadequate road<br />

infrastructure for heavy vehicles accessing<br />

national key points; if so,<br />

what are the relevant details;<br />

(2) whether, in view <strong>of</strong> the fatal road<br />

accident on Saturday, 9 August 2008<br />

(details furnished), his department<br />

will investigate the concerns with<br />

regard to heavy vehicles utilising<br />

inadequate infrastructure in residential<br />

areas; if not, what is the position<br />

in this regard; if so, what are the<br />

relevant details? NW2407E<br />

The MINISTER OF TRANSPORT:<br />

(1) The Department <strong>of</strong> Transport (DoT)<br />

has intensified its efforts with regard to<br />

the implementation <strong>of</strong> the National<br />

Freight Logistics Strategy since the<br />

Strategy’s approval by Cabinet in 2005.<br />

One <strong>of</strong> the key interventions by the<br />

DoT in dealing with constraints in<br />

efficiencies and limited infrastructure<br />

and operational capacities within the<br />

National Freight Logistics System, was<br />

the establishment <strong>of</strong> provincial institutional<br />

structures, namely, Provincial<br />

Freight Logistics Forums.<br />

The KwaZulu-Natal (KZN) Provincial<br />

Freight Logistics Forum (KZN Freight<br />

Task Group) and all other forums include<br />

the following key stakeholders,<br />

namely government departments (national,<br />

provincial and local municipalities),<br />

state-owned enterprises (SOEs),<br />

the private sector, organised labour and<br />

community organisations.<br />

(2) As highlighted in the response to part<br />

(1) above, the provincial Freight Logistics<br />

Forums were established to ensure<br />

that infrastructure and services enable<br />

safe passage <strong>of</strong> freight in a manner that<br />

does not pose a danger to communities.<br />

The KwaZulu-Natal provincial department<br />

<strong>of</strong> transport is addressing the<br />

concern raised in partnership with the<br />

Freight Forums.<br />

Status <strong>of</strong> claim in District Six<br />

1756. Mr A H NEL (DA) asked the Minister<br />

for Agriculture and Land Affairs:<br />

(a) What is the status <strong>of</strong> claim H48 in<br />

District Six, (b) what is the reason for the<br />

delay and (c) when can the settlement <strong>of</strong><br />

this claim be expected? NW2544E<br />

The MINISTER FOR AGRICULTURE<br />

AND LAND AFFAIRS:<br />

(a) The Regional Land Claims Commission:<br />

Western Cape (RLCC: WC) is in<br />

the process <strong>of</strong> appointing a service<br />

provider to conduct historical valuations<br />

on the subject land, in order to<br />

determine whether the claimants received<br />

just and equitable compensation<br />

at the time <strong>of</strong> dispossession.<br />

(b) The RLCC: WC deemed the land claim<br />

noncompliant with the Restitution <strong>of</strong><br />

Land Rights Act, 1994, as it appeared<br />

that the claimants received just and<br />

equitable compensation at the time <strong>of</strong><br />

dispossession. The claim therefore did<br />

not meet the requirements <strong>of</strong> section<br />

2(2)(a) and (b) <strong>of</strong> the Act.<br />

(c) The Commission undertakes to finalise<br />

the matter expeditiously, however, a<br />

specific timeframe cannot be pronounced<br />

due to the nature and complexity<br />

<strong>of</strong> the process <strong>of</strong> conducting<br />

historical valuations.<br />

Minister for Justice and Constitutional Development:<br />

(1) What is the current status <strong>of</strong> the
