COMMON CONSULAR INSTRUCTIONS<br />

on visas <strong>for</strong> the diplomatic missions and consular posts of the contracting parties to the Schengen<br />

Convention<br />

SUBJECT: Conditions governing the issue of uni<strong>for</strong>m visas, valid <strong>for</strong> the territory of all the<br />

Contracting Parties.<br />

I. GENERAL PROVISIONS<br />

1. Scope<br />

The following common provisions, which are based on the provisions of Chapter 3 (sections 1 and 2)<br />

of the Convention Implementing the Schengen Agreement of 14 June 1985 between the Governments<br />

of the States of the Benelux Economic Union, the Federal Republic of Germany and the French<br />

Republic on the gradual abolition of checks at their common borders (hereinafter referred to as "the<br />

Convention") signed in Schengen on 19 June 1990, and which Italy, Spain, Portugal, Greece and<br />

Austria have since acceded to, apply to the examination of visa applications <strong>for</strong> a visit not exceeding<br />

three months, including transit visas, valid <strong>for</strong> the territory of all the Contracting Parties. [1]<br />

Visas <strong>for</strong> visits exceeding three months remain subject to national procedures and only authorise the<br />

holder to stay in the one national territory. Nevertheless, such visas shall enable their holders to<br />

transit through the territories of the other Contracting Parties in order to reach the territory of the<br />

Contracting Party which issued the visa, unless they fail to fulfil the entry conditions referred to in<br />

Article 5(1)(a), (d) and (e) or they are on the national list of alerts of the Contracting Party through<br />

whose territory they seek to transit.<br />

2. Definition and types of visa<br />

2.1. Uni<strong>for</strong>m visas<br />

Uni<strong>for</strong>m visas are the authorisation or decision taking the <strong>for</strong>m of a sticker affixed by a Contracting<br />

Party to a passport, travel document or other document which entitles the holder to cross the border.<br />

It enables aliens subject to the visa requirement to present themselves at the external border of the<br />

Contracting Party which issued the visa or that of another Contracting Party and request, depending<br />
