Once the initial or extended deadline has expired, the central authority of the Contracting Party with<br />

which the application has been lodged may authorise the diplomatic mission or consular post to issue<br />

the uni<strong>for</strong>m visa.<br />

Where there is no clear decision on the part of the central authority, the diplomatic mission or<br />

consular post with which the application has been lodged may issue the visa after a period of 14 days<br />

has elapsed from the time at which the application was sent by the central authority carrying out the<br />

consultation. It is the responsibility of each central authority to in<strong>for</strong>m its missions and posts at the<br />

start of each consultation period.<br />

In cases where the central authority receives a request <strong>for</strong> an exceptional extension to the deadline, it<br />

shall notify the mission or post with which the application has been lodged accordingly: it shall not<br />

decide on the application be<strong>for</strong>e receiving clear instructions from its central authority.<br />

(g) Transmission of specific documents<br />

In exceptional cases, the embassy where the visa application is lodged may, at the request of the<br />

consular mission of the consulted State, transmit the visa application <strong>for</strong>m (with a space <strong>for</strong> a<br />

photograph) pursuant to Article 17 of the Schengen Convention.<br />

This procedure shall apply only in cities where there are diplomatic missions or consular posts of<br />

both the consulting State and consulted State and only in respect of the nationalities listed in Annex<br />

5B.<br />

Under no circumstances may the reply or the request to extend the deadline <strong>for</strong> consultation be<br />

transmitted locally, except in the case of consultation at local level in accordance with the current<br />

provisions of Annex 5B of the Common Consular Instructions on Visas. In principle, the consultation<br />

network shall be used <strong>for</strong> exchanges between the central authorities.<br />

2.4. Refusal to examine an application, to issue a visa<br />

The procedure and the possible channels of appeal in cases where the diplomatic mission or consular<br />

post of a Contracting Party refuses to examine an application or issue a visa are governed by the law<br />

of that Contracting Party.<br />

If a visa is refused and national law provides <strong>for</strong> the grounds <strong>for</strong> such a refusal to be given, this must<br />

be done on the basis of the following text:<br />

Your request <strong>for</strong> a visa has been refused pursuant to Article 15 in conjunction with Article 5 of the<br />

Convention implementing the Schengen Agreement of 19 June 1990 because you do not satisfy the<br />

conditions under a, c, d, e, (indicate relevant condition(s)) of Article 5(1) of the said Convention,<br />

which stipulates … (state relevant condition(s)).<br />
