There is no restriction on the strata<br />

subdivision <strong>of</strong> dual occupancies based<br />

on road frontage. The clause requires<br />

a minimum area <strong>of</strong> 580sqm for strata<br />

subdivision <strong>of</strong> such developments –<br />

this has been the required standard for<br />

many years.<br />

The definition <strong>of</strong> a dual occupancy<br />

development is 2 dwellings on 1 lot <strong>of</strong><br />

land. If the land were Torrens title<br />

subdivided it would result in 1 dwelling<br />

on 1 lot <strong>of</strong> land and therefore by<br />

definition no longer be a dual<br />

occupancy development. Also a<br />

Torrens title would result in land<br />

parcels having a land area <strong>of</strong><br />

approximately 290sqm. – such a<br />

change could undermine the existing<br />

580sqm required for normal shaped<br />

allotments.
