6 DRAFT RYDE LEP 2011 - SUBMISSIONS<br />

REPORT SUMMARY<br />

This report provides information on the exhibition <strong>of</strong> draft <strong>Ryde</strong> Local Environmental<br />

Plan (LEP) 2011 and on the outcomes <strong>of</strong> that community consultation process.<br />

A total <strong>of</strong> 3 259 submissions were received during the exhibition <strong>of</strong> draft LEP under<br />

both ‘Community Comment’ which occurred from the 19 January 2011 to the 29 May<br />

2012 and the formal exhibition <strong>of</strong> the Plan under the Environmental Planning and<br />

Assessment Act 1979 from the 30 May to the 13 July 2012.<br />

The principal issues raised in submissions were;<br />

Requests for increased floor space and height provisions for certain sites<br />

within Centres and local business zones.<br />

Deleting Clause 4.1C (d) (b) which requires a minimum road frontage <strong>of</strong> 20m<br />

for dual occupancy and multi dwelling housing developments.<br />

Requests from State authorities that land zoned SP2 which is surplus to their<br />

needs be rezoned to an adjoining zoning.<br />

Concern over the viability <strong>of</strong> the IN2 zone and inclusion <strong>of</strong> additional land uses<br />

“permitted with consent”.<br />

Retention <strong>of</strong> all open space land<br />

Objection to blanket prohibitions that exist within DLEP which fail to recognise<br />

“advertising signage” as a legitimate land use activity.<br />

A summary <strong>of</strong> points raised in submissions, Council’s response to those points and<br />

proposed actions are presented in Table 1 – Community Consultation Submissions<br />

and Table 2 – Formal Exhibition Submissions.<br />

It is proposed to amend the draft LEP to address a number <strong>of</strong> the issues raised in<br />

submissions, the principal changes include:<br />

1. Wholesale supplies, Building identification signs and Recreation facility<br />

(indoor) being added to uses permitted in the IN2 Light Industrial.<br />

2. Home business and Home industries being added as a permitted use in the<br />

R2, R3 and R4 zones.<br />

3. Land Reservation Acquisition Map being amended in line with requested RTA<br />

boundary changes.<br />

Further amendments to the draft Plan are also proposed to bring the plan in line with<br />

changes in supporting documents such as the Draft DCP 2011 and to correct<br />

identified omissions and errors. All such changes are identified in TABLE 3 –<br />

Amendments to DLEP 2011.<br />

The report recommends that Council amends the draft Plan in accordance with Table<br />

3 and that the plan be forwarded to the Department <strong>of</strong> Planning and Infrastructure<br />

(DoPI) with a Section 68 report requesting that the Minister make the Plan.<br />
