Context<br />
The following deadlines are required to be met:<br />
Under State Governments timetabling for the development <strong>of</strong> a comprehensive LEP<br />
for all Council areas within NSW the <strong>Ryde</strong> LEP 2011 - a comprehensive plan for the<br />
<strong>City</strong> <strong>of</strong> <strong>Ryde</strong> was to be completed by March 2011. No formal extension to this period<br />
has been given by DoPI. The March deadline has not being met due to:-<br />
the delay in the gazettal <strong>of</strong> LEP 2010 (Stage 1 <strong>of</strong> the 3 Stage process towards a<br />
comprehensive LEP for the <strong>City</strong> <strong>of</strong> <strong>Ryde</strong>) by the Minister for DoPI.<br />
the delay in receiving the S65 Certificate for draft LEP 2011 and<br />
the changes to the Standard Instrument by DoPI that occurred in February 2011.<br />
The Department is now requesting that we finalise the LEP by the end <strong>of</strong> 2012.<br />
Financial Implications<br />
Should Council resolve to adopt Draft LEP 2011 upon the gazettal <strong>of</strong> the Plan<br />
Council policy is to place an advertisement in the local paper. The cost <strong>of</strong> such an ad<br />
would be $1 000 and this is within the current budget Urban Planning budget for<br />
2011/2012.<br />
Policy Implications<br />
The recommendation is consistent with the requirements <strong>of</strong> the Environmental<br />
Planning and Assessment Act 1979.<br />
Other Options<br />
1. Council has an option not to proceed with DLEP 2011 - This option would result<br />
in the proposed changes to centres, small centres, residential choice and<br />
sustainability not being available to the community.<br />
Outcomes<br />
Redevelopment and revitalisation opportunities <strong>of</strong> Centres and Small Centres<br />
not realised.<br />
Residential development and choice not being expanded through the strata<br />
subdivisions.<br />
Flood, stormwater and sustainability controls not being applied through an<br />
LEP<br />
Numerous Planning Proposals being submitted to Council for land which<br />
under the DLEP was indicated for zoning floor space or height changes<br />
<strong>City</strong> <strong>of</strong> <strong>Ryde</strong> not being in compliance with the State Governments directions<br />
that all Council in NSW have a comprehensive LEP in place.<br />
LEP 2010 being maintained as the principle planning instrument for the <strong>City</strong> <strong>of</strong><br />
<strong>Ryde</strong>.<br />
2. Council has an option to defer consideration <strong>of</strong> the draft LEP - It should be<br />
noted that the process has already been underway for more than 5 years and it<br />
is considered that further significant delay in finalising the LEP has the potential<br />
to precipitate State Government involvement in Council’s plan making functions.<br />
