The R&MS requests amendment to DLEP to ensure child care centres,<br />

schools and places <strong>of</strong> worship and meeting halls are effectively prohibited<br />

where such properties have direct frontage to a classified Road.<br />

Response<br />

In the development <strong>of</strong> LEP 2010 the R&MS requested that an area <strong>of</strong> land (M2<br />

Motorway /Vimiera Rd) be indicated for acquisition on the Land Reservation<br />

Acquisition. DoPI by letter dated 22 August 2007 requested that as the land<br />

was owned by them that it be removed from the LEP 2010 Land Reservation<br />

Acquisition Map. The land was deleted from the subject map but retained as<br />

SP2 Classified Road on LEP 2010 Land Zoning Map<br />

As a result <strong>of</strong> a submission by the then RTA to LEP 2010 requesting that<br />

access for child care centres from classified roads be prohibited Clause 6.8<br />

Access for child care centre must not be to a classified road was included in<br />

the LEP. At the pre s64 review <strong>of</strong> DLEP 2011 DoPI advised Council to delete<br />

the Clause from the draft Plan and include it into a DCP.<br />

Recommended Actions<br />

1. Land Reservation Acquisition Map be amended in line with requested<br />

R&MS boundary changes (Council should note that DoPI requires all<br />

land identified on the Land Reservation Acquisition Map to be zoned on<br />

the Land Zoning Map according to its future use and as a result minor<br />

changes to the Land Zoning Map will also be required) and that the<br />

inclusion <strong>of</strong> land in Vimiera Rd on the Land Reservation Acquisition<br />

Map be highlighted to DoPI for their consideration.<br />

2. That DCP 2011 be amended to include a condition where relevant that<br />

access for child care centres, schools, meeting halls and places <strong>of</strong><br />

public worship must not be to a classified road.<br />

Issue 2- Sydney Water<br />

The SP2 zoning <strong>of</strong> 22 Henry St <strong>Ryde</strong> , 20 Goulding Street <strong>Ryde</strong> and 865 Victoria Rd<br />

West <strong>Ryde</strong> is in conflict with the Site Compatibility Certificates issued by DoPI .The<br />

LEP should be amended so the land is given the adjoining zoning.<br />

Response<br />

Council resolved on 14 February 2012 that an amended s65 Certificate be<br />

requested from DoPI that does not rezone any current SP2 land to any other<br />

purpose. This request was supported by DoPI.<br />

As such it is not considered that Council should support the rezoning <strong>of</strong> the<br />

lands to R2.<br />

No amendment to the DLEP 2011 required.<br />

West <strong>Ryde</strong> Town Centre – 3 submissions<br />

Issue<br />

Properties located at 6-8 Wattle St, 80 Anzac Ave, 29 – 33 Herbert St should<br />

have the same FSR as properties along Herbert St – 1.25:1.<br />
