(b) That a submission is made to the Department <strong>of</strong> Planning and Infrastructure<br />

and State Property Authority expressing Council’s concern about the possible<br />

sale <strong>of</strong> land associated with Small’s Road <strong>Ryde</strong> School and requesting that the<br />

Small’s Road <strong>Ryde</strong> School land be retained either as a school site or dedicated<br />

open space.<br />

(c) That the rezoning <strong>of</strong> Kitty’s Creek Reserve adjacent to 46 Jeanette Street <strong>Ryde</strong><br />

from an E2 zone to a R2 zone not proceed.<br />

A letter requesting the above amendments and expressing Council’s concerns with<br />

respect to Small’s Road School was sent to the Director General <strong>of</strong> the Department<br />

<strong>of</strong> Infrastructure and Planning on the 15 December 2011.<br />

In response to Council’s letter <strong>of</strong> the 15 December 2011 an amended Section 65<br />

Certificate dated 20 December 2011 was issued by DoPI. The Certificate addressed<br />

all <strong>of</strong> Council’s issues with the exception <strong>of</strong> the following;<br />

The rezoning <strong>of</strong> Cudal Reserve to RE1 Public Recreation (Note: Cudal<br />

Reserve was to remain SP2).<br />

Rezoning a small area <strong>of</strong> Kitty’s Creek Reserve from R2 Low Density<br />

Residential to E2 Environmental Conservation and the subsequent deleting <strong>of</strong><br />

the proposed reclassification <strong>of</strong> the subject land to operational.<br />

Council on the 14 February 2012 resolved in part:<br />

1. that an amended Section 65 Certificate be requested that did not<br />

rezone any current SP2 land to other purposes and that such zoning be<br />

reflected in the Draft LEP for public exhibition.<br />

2. That Council authorise that Draft <strong>Ryde</strong> Local Environmental Plan 2011<br />

be placed on exhibition in accordance with the requirements for the<br />

exhibition <strong>of</strong> draft local environmental plans as specified by the<br />

Environmental Planning and Assessment act 1979.<br />

Council forwarded to DoPI on 5 April 2012 draft LEP 2011 amended in accordance<br />

with the conditions <strong>of</strong> the Section 65 Certificate dated 20 December 2011, previous<br />

Council resolutions not addressed in Section 65 Certificate i.e. Kitty’s Creek Reserve<br />

and amended maps reflecting the reinstatement <strong>of</strong> the SP2 zones.<br />

Council on the 23 April 2012 received an unconditional Section 65 Certificate from<br />

the DoPI to exhibit draft <strong>Ryde</strong> LEP 2011.<br />

Discussion<br />

Draft LEP 2011 was placed on Community Comment from the 19 January 2011 to<br />

the 29 May 2012.<br />

The “Community Comment” exhibition <strong>of</strong> the draft Plan included the following;<br />

1. Information on Council’s webpage including;<br />

a. DLEP 2011 written document and maps<br />

b. Background information on LEPs , DCPs , <strong>City</strong> <strong>of</strong> <strong>Ryde</strong> Planning Study<br />

and DLEP 2011<br />

c. Key documents e.g. Council reports , table <strong>of</strong> changes, land use matrix<br />

d. An invitation to make submission<br />
