Chapter 3: European Union Member States<br />

(as described in Chapter 2). This applies whe<strong>the</strong>r <strong>the</strong> <strong>export</strong> is temporary, e.g. for a<br />

concert <strong>to</strong>ur, or permanent.<br />

I am a <strong>to</strong>urist visiting Greece. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />

The <strong>export</strong> regulations apply <strong>to</strong> anyone who wants <strong>to</strong> take <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> a certain<br />

age <strong>and</strong> value from Greece <strong>to</strong> <strong>Russia</strong> (or <strong>to</strong> ano<strong>the</strong>r country). You must go through <strong>the</strong><br />

application process with <strong>the</strong> national authorities in order for <strong>the</strong> <strong>goods</strong> <strong>to</strong> be cleared<br />

for <strong>export</strong>.<br />

If you have bought <strong>the</strong> art work, antique, furniture or o<strong>the</strong>r <strong>cultural</strong> <strong>goods</strong> from a reputable<br />

art or antique dealer, ask <strong>the</strong>m about whe<strong>the</strong>r <strong>the</strong> object can be <strong>export</strong>ed or not.<br />

Antique dealers <strong>and</strong> collec<strong>to</strong>rs are recognised under law in Greece <strong>and</strong> <strong>the</strong> scope <strong>of</strong><br />

<strong>the</strong>ir activities is determined by national legislation. Antique dealers must have a permit<br />

<strong>to</strong> exercise <strong>the</strong> pr<strong>of</strong>ession <strong>and</strong> must register any <strong>import</strong> or <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> <strong>to</strong><br />

<strong>and</strong> from <strong>the</strong>ir shops.<br />

Since <strong>the</strong> application process can take four months or more, you should note that <strong>the</strong><br />

<strong>goods</strong> must remain in Greece until <strong>the</strong> licence has been granted, after which you can<br />

organise transportation or collect <strong>the</strong> <strong>goods</strong> in person.<br />

If you are in any doubt, check <strong>the</strong> age <strong>and</strong> value <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong>. This determines<br />

whe<strong>the</strong>r an EU <strong>export</strong> licence is required. In general, <strong>the</strong> <strong>export</strong> controls apply <strong>to</strong> <strong>cultural</strong><br />

<strong>goods</strong> which are over 50 years old <strong>and</strong> <strong>of</strong> a certain value, with <strong>the</strong> exception <strong>of</strong><br />

archaeological objects which are protected independent <strong>of</strong> <strong>the</strong>ir value. See Chapter 2<br />

for more details.<br />

Is <strong>the</strong>re a fee for an <strong>export</strong> licence?<br />

No – <strong>the</strong>re is no fee for <strong>the</strong> licence.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

Under Council Regulation 3911/92, <strong>the</strong>re are value <strong>and</strong> age thresholds which determine<br />

which <strong>cultural</strong> objects require an EU <strong>export</strong> licence. Archaeological objects require <strong>export</strong><br />

licences independent <strong>of</strong> <strong>the</strong>ir value. Therefore, if <strong>the</strong> age, value or o<strong>the</strong>r determinants need<br />

<strong>to</strong> be assessed, <strong>the</strong> <strong>cultural</strong> object may have <strong>to</strong> be inspected.<br />

The valuing <strong>of</strong> ‘movable monuments’ is done according <strong>to</strong> <strong>the</strong> law by a committee <strong>of</strong> three<br />

specialists set up by a decision <strong>of</strong> <strong>the</strong> Minister <strong>of</strong> Culture, following <strong>the</strong> recommendation<br />

<strong>of</strong> <strong>the</strong> Central Archaeological Council.<br />

Can I appeal against <strong>the</strong> valuation? If so, how do I do this?<br />

You cannot appeal against <strong>the</strong> valuation for <strong>export</strong> purposes. It is not possible <strong>to</strong> appeal<br />

on <strong>the</strong> age <strong>and</strong> national <strong>import</strong>ance since <strong>the</strong>se are provided for in Law 3028/02.<br />
