I am a musician. Do I need <strong>to</strong> know about <strong>export</strong> regulations if I am travelling with my<br />

instrument?<br />

Yes. Any musician who wishes <strong>to</strong> travel outside <strong>the</strong> European Union with a musical instrument<br />

which is over a certain age <strong>and</strong> value must obtain an EU <strong>export</strong> licence (as described<br />

in Chapter 2). This applies whe<strong>the</strong>r <strong>the</strong> <strong>export</strong> is temporary, e.g. for a concert <strong>to</strong>ur, or<br />

permanent.<br />

I am a <strong>to</strong>urist visiting Es<strong>to</strong>nia. If I buy a work <strong>of</strong> art, how do I take it home with me?<br />

The <strong>export</strong> regulations apply <strong>to</strong> anyone who wants <strong>to</strong> take <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> a certain<br />

age <strong>and</strong> value from Es<strong>to</strong>nia <strong>to</strong> <strong>Russia</strong> (or <strong>to</strong> ano<strong>the</strong>r country outside <strong>the</strong> EU).<br />

You must go through <strong>the</strong> application process in order for <strong>the</strong> <strong>goods</strong> <strong>to</strong> be cleared<br />

for <strong>export</strong>.<br />

If you have bought <strong>the</strong> art work, antique, furniture or o<strong>the</strong>r <strong>cultural</strong> <strong>goods</strong> from a reputable<br />

art or antique dealer, ask <strong>the</strong>ir advice on how <strong>to</strong> apply for <strong>the</strong> <strong>export</strong> licence.<br />

While <strong>the</strong> application is being processed, you should note that <strong>the</strong> <strong>goods</strong> must remain in<br />

Es<strong>to</strong>nia until <strong>the</strong> licence has been granted. You may <strong>the</strong>refore have <strong>to</strong> arrange for transportation<br />

at a later date.<br />

If you are in any doubt, check <strong>the</strong> age <strong>and</strong> value <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong>. This determines<br />

whe<strong>the</strong>r an <strong>export</strong> licence is required. In general, <strong>the</strong> <strong>export</strong> controls apply <strong>to</strong> <strong>cultural</strong><br />

<strong>goods</strong> which are over 50 years old <strong>and</strong> <strong>of</strong> a certain value.<br />

Does <strong>the</strong> <strong>cultural</strong> object need <strong>to</strong> be valued? If so, who will do this?<br />

The NHB will assess your object <strong>to</strong> establish whe<strong>the</strong>r it can be considered a movable<br />

monument. If this is <strong>the</strong> case, <strong>the</strong> NHB can place <strong>the</strong> object under temporary protection<br />

which excludes <strong>export</strong>, until <strong>the</strong> Minister <strong>of</strong> Culture decides whe<strong>the</strong>r or not <strong>to</strong> designate<br />

<strong>the</strong> object as movable monument.<br />

Which cus<strong>to</strong>ms authorities are empowered <strong>to</strong> deal with <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>?<br />

What o<strong>the</strong>r paperwork do I need <strong>to</strong> <strong>export</strong> a <strong>cultural</strong> object?<br />

You need <strong>to</strong> present <strong>the</strong> <strong>export</strong> licence <strong>to</strong>ge<strong>the</strong>r with <strong>the</strong> <strong>export</strong> declaration.<br />

What are <strong>the</strong> penalties if I do something wrong?<br />

The liability for violation <strong>of</strong> <strong>cultural</strong> heritage legislation includes fines <strong>and</strong>, in certain cases,<br />

<strong>the</strong> sanctions foreseen in <strong>the</strong> Criminal Code.<br />
