Chapter 3: European Union Member States<br />

A specific open <strong>export</strong> licence is issued for <strong>the</strong> repeated temporary <strong>export</strong> <strong>of</strong> a specific<br />

object whose owner or lawful possessor is a specific person or organisation who will use<br />

or exhibit <strong>the</strong> object. The licence is valid for a maximum <strong>of</strong> five years.<br />

A general open <strong>export</strong> licence can be issued <strong>to</strong> museums <strong>and</strong> o<strong>the</strong>r institutions <strong>to</strong> cover<br />

repeated temporary <strong>export</strong>s <strong>of</strong> objects which are part <strong>of</strong> a permanent collection. The<br />

licence is valid for a maximum <strong>of</strong> five years.<br />

Specific <strong>and</strong> general open <strong>export</strong> licences were introduced following <strong>the</strong> provisions <strong>of</strong><br />

Council Regulation 1526/98. This was approved by <strong>the</strong> Slovenian authorities since <strong>the</strong>se<br />

types <strong>of</strong> licence significantly simplify <strong>the</strong> multiple <strong>export</strong> <strong>of</strong> <strong>the</strong> same object, particularly<br />

for <strong>cultural</strong> heritage protection institutions that <strong>export</strong> objects for exhibition purposes.<br />

What are my first steps? How do I plan this process <strong>and</strong> how long might it take?<br />

If your object is a <strong>cultural</strong> good as defined by EU legislation on <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong><br />

<strong>and</strong>/or Slovenian law, you must apply for an <strong>export</strong> licence <strong>to</strong> <strong>the</strong> Ministry <strong>of</strong> Culture. The<br />

application can be made by you (<strong>the</strong> <strong>export</strong>er) or a person authorised by you.<br />

The application form is in English <strong>and</strong> Slovene <strong>and</strong> conforms <strong>to</strong> <strong>the</strong> regulations on <strong>the</strong> EU<br />

<strong>export</strong> licence. You must present <strong>the</strong> application with a stamp confirming that you have<br />

paid <strong>the</strong> administrative duty applicable <strong>to</strong> this procedure.<br />

The object will be subject <strong>to</strong> expert opinion from one <strong>of</strong> <strong>the</strong> competent national museums.<br />

They have 14 days <strong>to</strong> give an opinion from <strong>the</strong> time <strong>the</strong>y are requested by <strong>the</strong> Ministry <strong>of</strong><br />

Culture.<br />

If you have an object that you intend <strong>to</strong> <strong>export</strong> temporarily several times over a maximum<br />

period <strong>of</strong> five years (such as an old musical instrument you need for performances<br />

abroad), <strong>the</strong> expert opinion will also assess whe<strong>the</strong>r you <strong>of</strong>fer all necessary guarantees<br />

for <strong>the</strong> return <strong>of</strong> <strong>the</strong> object <strong>to</strong> Slovenia in good condition. It will also require <strong>the</strong> object <strong>to</strong><br />

be described <strong>and</strong> labelled in such a way that during <strong>the</strong> period <strong>of</strong> <strong>the</strong> temporary <strong>export</strong><br />

<strong>the</strong>re is no doubt that <strong>the</strong> object being <strong>export</strong>ed is <strong>the</strong> same as <strong>the</strong> one described in <strong>the</strong><br />

special open licence.<br />

For permanent <strong>export</strong> abroad <strong>the</strong> procedure for issuing <strong>the</strong> licence can take up <strong>to</strong> three<br />

weeks.<br />

How do I find out if <strong>the</strong> art object I want <strong>to</strong> <strong>export</strong> is <strong>of</strong> national significance? Is <strong>the</strong>re a Public<br />

Inven<strong>to</strong>ry <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> special interest or <strong>import</strong>ance?<br />

There is a Centre for Information <strong>and</strong> Documentation on Cultural Heritage attached <strong>to</strong> <strong>the</strong><br />

Direc<strong>to</strong>rate for Cultural Heritage in <strong>the</strong> Ministry <strong>of</strong> Culture.<br />

Under Slovenian legislation, if it is established during <strong>the</strong> procedure <strong>of</strong> issuing an <strong>export</strong><br />

licence or transfer licence that an object does not belong <strong>to</strong> any <strong>of</strong> <strong>the</strong> <strong>cultural</strong> <strong>goods</strong><br />
