Hungary<br />

typical objects, images, sound recordings <strong>and</strong> written memories <strong>and</strong> o<strong>the</strong>r pro<strong>of</strong> <strong>of</strong> <strong>the</strong><br />

origin <strong>and</strong> development <strong>of</strong> lifeless <strong>and</strong> live nature, mankind, <strong>the</strong> Hungarian nation <strong>and</strong> <strong>the</strong><br />

his<strong>to</strong>ry <strong>of</strong> Hungary, as well as pieces <strong>of</strong> arts”.<br />

You also need an <strong>export</strong> licence if your object falls under any <strong>of</strong> <strong>the</strong> categories (<strong>and</strong> age or age<br />

<strong>and</strong> value thresholds) listed under Council Regulation 3911/92 on <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> <strong>goods</strong>.<br />

In practice, you must bear in mind that <strong>the</strong> <strong>export</strong> <strong>of</strong> any <strong>cultural</strong> good over 50 years <strong>of</strong><br />

age is subject <strong>to</strong> licensing.<br />

Moreover, under certain cases foreseen in Act No. 64, for <strong>the</strong> <strong>export</strong> <strong>of</strong> <strong>cultural</strong> objects under<br />

50 years <strong>of</strong> age, you may be required <strong>to</strong> present a certificate from <strong>the</strong> National Office<br />

<strong>of</strong> Cultural Heritage. This is not an <strong>export</strong> licence, since <strong>the</strong>se <strong>goods</strong> do not need special<br />

permission <strong>to</strong> be removed from Hungary. You are advised <strong>to</strong> contact <strong>the</strong> National Office<br />

<strong>of</strong> Cultural Heritage <strong>to</strong> see if your object needs such a certificate.<br />

Are <strong>the</strong>re different types <strong>of</strong> licence? What type <strong>of</strong> licence do I need?<br />

The National Office <strong>of</strong> Cultural Heritage issues both EU <strong>export</strong> licences <strong>and</strong> National <strong>export</strong><br />

licences. EU <strong>export</strong> licences are needed for <strong>the</strong> <strong>export</strong> outside <strong>of</strong> <strong>the</strong> cus<strong>to</strong>ms area <strong>of</strong> <strong>the</strong> EU<br />

<strong>of</strong> <strong>cultural</strong> <strong>goods</strong> as defined in Council Regulation 3911/92. National licences are needed for<br />

<strong>export</strong> outside Hungary <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> as defined under national legislation.<br />

Depending on <strong>the</strong> circumstances, you may <strong>the</strong>refore find that your object requires one or<br />

both licences. The National Office <strong>of</strong> Cultural Heritage can provide more information.<br />

Export licences can be for permanent or temporary <strong>export</strong>. Permanent <strong>export</strong> licences<br />

can be used within a year from <strong>the</strong>ir date <strong>of</strong> issue. Temporary <strong>export</strong> is allowed until <strong>the</strong><br />

date <strong>of</strong> return fixed in <strong>the</strong> licence.<br />

What are my first steps? How do I plan this process <strong>and</strong> how long might it take?<br />

For <strong>the</strong> issue <strong>of</strong> an <strong>export</strong> licence you must apply <strong>to</strong> <strong>the</strong> National Office <strong>of</strong> Cultural Heritage.<br />

This authority will take a decision only after relevant expert opinion has been obtained.<br />

How do I find if <strong>the</strong> art object I want <strong>to</strong> <strong>export</strong> is <strong>of</strong> national significance? Is <strong>the</strong>re a Public<br />

Inven<strong>to</strong>ry <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> <strong>of</strong> special interest or <strong>import</strong>ance?<br />

The list <strong>of</strong> categories <strong>of</strong> <strong>goods</strong> that are specially protected is included in Act No. 64.<br />

Moreover, <strong>the</strong> National Office <strong>of</strong> Cultural Heritage can specifically declare <strong>goods</strong> <strong>to</strong> be<br />

protected <strong>and</strong> thus banned from permanent <strong>export</strong>.<br />

Do museums <strong>and</strong> galleries need licences for temporary <strong>export</strong>s (e.g. a <strong>to</strong>uring exhibition)? Do<br />

non-pr<strong>of</strong>it organisations need <strong>export</strong> licences?<br />
