Do I need an <strong>export</strong> licence?<br />

There are two types <strong>of</strong> <strong>cultural</strong> <strong>goods</strong> defined<br />

under <strong>the</strong> national legislation. For <strong>the</strong> first<br />

type, ‘objects <strong>of</strong> <strong>cultural</strong> value’, a Certificate<br />

is required under Czech national legislation<br />

<strong>to</strong> take <strong>the</strong>m out <strong>of</strong> <strong>the</strong> country, whe<strong>the</strong>r on<br />

a temporary or permanent basis. The second<br />

type is ‘collections <strong>of</strong> museum character’,<br />

mostly objects kept in museums <strong>and</strong> galleries,<br />

<strong>and</strong> <strong>the</strong>se enjoy a higher level <strong>of</strong> protection.<br />

Such objects are only allowed <strong>to</strong> leave <strong>the</strong><br />

country on a temporary basis, for exhibition,<br />

conservation, res<strong>to</strong>ration or study, <strong>and</strong> require<br />

a Permit under Czech national legislation.<br />

In addition <strong>to</strong> Czech national legislation, EU<br />

legislation (as described in Chapter 2) applies<br />

<strong>to</strong> <strong>cultural</strong> <strong>goods</strong> which are <strong>export</strong>ed<br />

from <strong>the</strong> Czech Republic <strong>to</strong> <strong>Russia</strong>, or <strong>to</strong><br />

any o<strong>the</strong>r country outside <strong>the</strong> European Union.<br />

Cultural <strong>goods</strong> which come under this<br />

legislation (<strong>the</strong> regulations determine <strong>the</strong><br />

categories, age or age <strong>and</strong> value thresholds)<br />

must have an EU <strong>export</strong> licence.<br />

The regulations for <strong>export</strong> licences apply<br />

<strong>to</strong> anyone who is <strong>export</strong>ing <strong>cultural</strong> <strong>goods</strong><br />

from <strong>the</strong> Czech Republic <strong>to</strong> ano<strong>the</strong>r country.<br />

They apply, whatever your nationality,<br />

citizenship, place <strong>of</strong> residence or age. They<br />

apply whe<strong>the</strong>r you are an individual, a company<br />

(commercial or non-pr<strong>of</strong>it), a public<br />

institution or o<strong>the</strong>r organisation.<br />

• The Permit (for museum collection<br />
